EDIT ... I do agree with your post on Kratom... it is very effective for pain... just make sure you get it from a reputable vendor. Problem is that stuff is mostly sold in head and smoke shops, and comes straight from Indonesia... Pretty much impossible to know what you're getting unless you lab test it... it is great For pain though, feels just like an opioid ... and is 100% legal for now....I believe it will be outlawed at some point

No question that you are correct on whether the Medical Licensing Board would care, just as much as Law Enforcement. That is a reality.
The other way to look at this is as a moral issue. This guy is about as close to deaths door as you can be, and he is clearly suffering. If I were in his shoes, I wouldn't care what the drug laws were, as long as I didn't hurt anybody else by using them.
I also know that if I were on a jury and a case came before me where this guy was being prosecuted for drug charges for cannabis in his current medical state, NO FREAKING WAY am I going to vote to convict him NO WAY! I would sure as hell hope there would be a majority on that jury who would agree with me.
I believe the laws need to be changed in our state. Who are we to judge the actions of someone who is at deaths door and in very real pain and suffering? How can you call yourself a compassionate person and not tolerate people in these kinds of situations seeking relief?
I have personally witnessed my sister, brother, mother and father, aunts, and good friends too, die from cancer, Pain, suffering and misery at the end of their life. The worst kind. Anybody who tries to tell me they didn't deserve a better end is full of BS. Every one of these good people deserved better choices.
