So, if Miles would have pulled the trigger and committed the murder instead of Davis, Miller would then, and only then, be directly implicated.

It would seem the second part after "intent", "or, assist in the commission of the offense", would warrant Miller being an accessory before the fact of the offense.

It's still hard for me to believe that Miller can now basically say he had no idea that the gun he delivered to an eventual capital murder was actually going to be used for said murder.

I have a hard time believing that a competent DA couldn't prove intent by someone handing another person a loaded gun outside of a club while blocking their car in.

Regardless, the NCAA and the SEC doesn't necessarily need the same justification.

You can't divide the statute up like that.

A proper reading of that part would be the "intent to assist in the commission of the offense". It's always an intent problem. Intent can be tricky to prove even for the person who pulled the trigger in many cases. Here it's many times more difficult.

Yes, if the person Miller directly gave the gun to pulled the trigger, that would certainly help any potential prosecution. But it still wouldn't necessarily solve the intent problem.

Also, just so we're clear, this is for a charge of "accomplice" to murder. That distinction probably doesn't mean anything to non-lawyers, but it is important: accessory to murder is a completely different charge under a different statue, and it has an even higher bar to clear.

Deep intrication of collegiate athletes with criminal activities could quite well be a feature not a bug. What if 247 showed arrest history & convictions along with height & weight and offers & interest? What if it was publicized days in advance that a player had warrants, and he/she still decided to show up and represent their school (think about the halftime show being interrupted by a federal fugitive task force performing a felony arrest...)? The possibilities are endless, especially for low-traffic sports like equestrian and quidditch.

And once again Alabama is leading the pack!

It is just incredible that a guy looking at 9 figures is still inclined to act like he's in the hood. I have no idea the legal implications but it seems to me he wouldn't have handed it over loaded with a round in the chamber...and announce just that as he handed it off if he was just returning the pistol. Pure stupidity to be anywhere near this scene.

Nothing is going to happen. Bama kept the details quiet until now, and law enforcement has said no charges are forthcoming, so that's good enough to let Miller keep playing.

I don't think intent is the issue you're making it out to be.

A person is legally accountable for the behavior of another constituting a criminal offense if, with the intent to promote or assist the commission of the offense:
...
(2) He aids or abets such other person in committing the offense

(the elements are written in the alternative so only have to prove one of the three)

He showed up, blocked the victim's car in, and provided a loaded weapon. You often have to show intent indirectly since you only rarely get a confession in which the defendant says "I performed this action with this intent." The provision of the loaded gun + blocking the car seems like enough for any DA with a pulse.

I am certain that any person in my phone contacts would not bring me a gun at 1 AM if I were to text them to deliver it ~ regardless of who owns the gun.

And why would they have the gun in the first place?

A woman is dead because of that piece of crap.

They had Miller's dash cam footage and there are plenty of cameras in the area. If he "blocked the car in" to the extent some people are claiming, then yes, I agree that would likely be enough to help satisfy the standard. But their reaction to the evidence that was available to them, as well as some conflicting reports that the one of the victims was able to drive away after the gunshots indicates to me that this particular piece of evidence is not as strong as some people are implying. I haven't seen the evidence, so it's hard to say.

As I mentioned, I don't practice criminal law, I could be wrong. But most of the legal analysis I have seen aligns with what I have said in this thread.

This. What did he think he was going to do with a loaded pistol at that time of the morning when tempers are flaring? Can't believe that there isn't some criminal charge to this, but that's some literal weapons grade stupidity by Miller. He's certainly not going to check off any judgement or character boxes on the scouting reports.

I know jack **** about the case, but according to the guy who summarized the facts on page 1, Miller did indeed block the victim's car with his.
