I deeply respect the caliber of legal reasoning that is so often found on this board, including in this thread. The only opinion that matters in determining whether the **** trademark scam is actionable is that of the AG and I promise you, one way or another, this scam will come before the AG. High ranking state employees, highly questionable behavior, millions of dollars involved and the unquestioned understanding the behavior will continue until and unless someone steps in to halt it, all justify a review by the AG.

Yes. Trademark is Federal. The state AG won't have anything to do with it whatsoever. Anyone saying otherwise has no clue what they are talking about. Even if A&M knowingly and fraudulently acquired trademarks, the Texas AG still wouldn't do anything other than follow the case in the news when it goes to Federal court.

To be fair to Duke, not that he deserves it, I think he is saying that the actions taken by state employees to protect a trademark he deems fraudulent oversteps their state constitutional priveledges. He is hoping for punishment of some administrators, not the trademark itself since he is starting to accept that that won't happen on the basis that currently exists. I have no idea if he is correct about that assuming it were fraudulent.

This could be his ace in the hole since that would potentially legitimize the premise that the mark is fraudulent. The problem is, fraud would need to be determined by its legal elements first before the Texas AG could act. Not simply because he keeps referring to the mark as fraudulent.

He is fundamentally begging the question.

1) Just protecting a trademark in of itself is not and never can be fraud. To be fraud, you have to knowingly have filed for a trademark using misrepresented facts.

2) Unfortunately for Dukey Dumbass, his quest for quibbling details does not constitute proof that our trademark was obtained fraudulently no matter what Duke thinks simply because we have enough historical evidence that shows E. King Gill did in fact come down from the stands and suit up for A&M, ready to play if needed. And that's all we need. None of the other details matter no matter how much Randy wants them to. Nor does it matter exactly when the 12th man tradition coalesced after Gill. All that matters is A&M can show a clear history of use since the 20s/30s and most importantly was the first to file for the trademark.

It's like he doesn't realize that every time we sue someone, our legal right to the trademark gets examined, and confirmed. There is no fraud. He clearly doesn't know what fraud is to begin with, and literally nobody will do anything about it, ever. Much less the *******ed AG of Texas.

What's funny to me about this whole thing is that Duke has proven to everybody that he has exhibited the attributes of a cult leader as opposed to proving that we area cult.

Yeah, people started using them as insults, so these words lost a lot of credibility as good scientific descriptions. I think we might be moving that way with the word "r-e-t-a-r-d-e-d" as well. We still use the classification of "MR," or Mentally ********," but I have a feeling it'll be replaced soon with something more clinical sounding, like "learning challenged," or some such.
