I believe this is the same court system that ruled a chicken isn't an "animal". Oh well, it sounded like a good idea... too bad some toothless, six-toed, web footed okies had to get involved and ruin it for everybody:

Court Blocks Do-Not-Call List
By REUTERS

WASHINGTON (Reuters) - A U.S. court in Oklahoma has blocked the national "do not call" list that would allow consumers to stop most unwanted telephone sales calls, the Direct Marketing Association said on Wednesday.
The U.S. District Court in Oklahoma City said the Federal Trade Commission overstepped its authority when it set up the popular anti-telemarketing measure, according to the DMA.
The FTC had signed up some 50 million phone numbers for the list, which was due to take effect on Oct. 1.

This doesn't shock me.

Telemarketing is a high-end industry in oklahoma. Their lobby rivals the Bingo lobby, and is almost as powerful as the noodling lobby.

Don't forget the cockfighting lobby... those guys are holding almost as many cards as the noodlers (is that a word, really?)!

Is it to late to make them a territory of Puerto Rico?

Bi, the cock fighting lobby is less effective since the cocks are expected to argue on their own behalf. Sure, they win a few battles here and there, but lately their actual humanity as been drawn into question by meddling out-of-staters.

No kidding! Can you imagine the hit my meth operation would take if all those telemarketers in Oklahoma lost their jobs?

I realize this is all smack, but that's not an Oklahoma court. It's a federal court.

The do not call list is the dumbest piece of legislation ever passed!!! Because of all you fat, lazy SOB's, my company (a phone compay) is going to lose at least $25 million in revenue in the next 9-12 months. What a crock, watch the economy take a nose dive, as phone companies and telemarketing companies go out of business, people lose jobs, and unemployment skyrockets!!

as phone companies and telemarketing companies go out of business

For one thing, phone companies have already been going out of business as it is difficult for them to turn a profit in the current state. Secondly, telemarketing firms will switch to junkmail. Companies will adapt and find ways to connect to the customers. Successful companies will figure this out.

I would rather throw away junkmail rather than take a wakeup call from MCI on my day off from work.

I could not agree more.

I also heard this ruling will not effect the Texas no-call list which has done a wonderful job of eliminating nearly all telemarketing calls to my household.

U.S. district judge who blocked do-not-call list is flooded with calls from angry consumers

JULIE E. BISBEE
Associated Press Writer
OKLAHOMA CITY — U.S. District Judge Lee R. West's telephone has not stopped ringing since he sided with telemarketers seeking to block a popular national do-not-call list.

Egged on by talk show hosts and angry Web sites, people have flooded West's office and home with calls and faxes, apparently trying to show him why they wanted to ban unsolicited sales calls.

"They are just calling to tie up our lines," said Rick Wade, operations manager at the district clerk's office. "They just keep calling to harass us, like the telemarketers harass them, I guess."

The phones at the federal courthouse were jammed Thursday morning and voicemail boxes were stuffed with messages blasting West's ruling that the Federal Trade Commission lacked authority to create and operate the registry.

West's home and office telephone numbers were posted on the Internet, and consumers angry with the ruling were encouraged to call. Calls by The Associated Press to West's home seeking comment were blocked by busy signals.

The ruling even made late-night television talk show host Jay Leno's monologue Wednesday night.

"The judge says the telemarketers can call you whenever they want," Leno said. "You know what we should do? Let's all call this judge tonight at home during dinner."

West did please some businesses with his ruling Tuesday. Telemarketers say the list would devastate their industry and lead to the loss of thousands of jobs.

Rick Ratliff, president of U.S. Security, Inc., one of the plaintiffs in a lawsuit challenging the list, said his company laid off half of its 600 employees because of restrictions on telemarketing.

"U.S. Security does not sell anything over the phone," he said. "We simply ask for the opportunity to tell someone about the lifesaving benefits of our security and fire systems in a face-to-face meeting."

The do-not-call registry appears that it will go forward after all. The House approved legislation Thursday intended to ensure the list goes into effect next week. After less than an hour of debate, which included potshots at West from both parties, House members voted 412-8 to approve the bill.

A mere 50 million people signed up to keep this intrusion out of their lives.

I don't know how many signed up for the two Texas do not call lists previously - I think it was 3 million at $3 per head.

Additionally many of us now own spam blocking software.

The phone company gets rich selling caller ID and call blockers.

Spam messages to cell phones is starting up with no solution available yet.

The judges just don't get it.

Stupid SOB judges. This makes me so mad I can hardly see straight.

"Commercial free speech" my ass. I don't care if a company wants to advertise via TV or junk mail - they pay for it and I can ignore it by changing the channel or throwing their crap in the trash.

Unsolicited phone calls (and emails as well) are on MY DIME. I pay for the service that gives telescum and spammers the ability to contact me. Of course this does not mean I WANT them to contact me, it just means they can.

Ah, but "commerical free speech" apparently gives them the right to do so. Really? I don't see that guaranteed in the constitution anywhere. And besides, it's a waste of resources to try to sell me anything over the phone anyway. I absolutely will not purchase anything from a company or donate to any charity that contacts me via telescum. If anything, shouldn't these idiots want there to be a list so they don't waste time contacting me?

What is the difference between this list and putting a "No Soliciting" sign on my front door? Zero.

I hope these judges get 100 people ringing their doorbell, 1000 phone calls, and 10000 pieces of spam every damn day for the rest of their lives.

That's what is so stupid about the new cell phone text messaging campaign. Not only are you getting spam, but YOU are having to pay for it!

what irritates me is that now, they are trying to say it goes against free speech and they should be able to call if they want to.

sorry, I know this is a stretch, but why is it ok and legal for restaraunts and other places of business to place "no soliciting" signs on their doors, but I cant tell people not to call me to try and sell me **** I dont want....

I just read through a copy of the bill I got this morning, and see some major loops holes in it. This bill will not even block half of the calls you get. I dont even know why I go so pissed about it.

This law will still allow politicians, charities, church groups, and any company that you have had an affiliation with in the last two years to call you.

Looks to me like the big corporations have made a business decision. Why give a lot more money to politicians that you've already contributed to so they would appoint business friendly judges when those judges will take care of the problem for you? Let the law pass and count on the judges to block it. Seems like sound reasoning to me.

I manage to get a lot of bile out of my system when they call personally. I know y'all can't believe it, but I am somewhat rude. The machine dial crap I hang up on at the click.
