I have seen very rational and educated people make a lot of mistakes for very inexplicable reasons when dealing with family and inheritance. It is very easy and common for a family to get destroyed over something that could have been handled easily beforehand or even after the fact but for emotion.
Almost always there is a good and reasonable solution if people are willing and open to finding it.
This is why I always tell people to go talk to a real estate attorney that is knowledgeable about handling estates. They can take the emotion out of a situation, listen to everyone's concerns, and come up with a plan that best addresses everyone's issues. It will cost some money, but it will save everyone from a bunch of emotional distress later on down the road.
We do this stuff all the time (not in tx, can't help). The last time we had someone throwing a fit over wanting their inheritance now (before the parents died), the parents came in and changed their wills. The kids won't be happy with the result, as they were effectively "written out" of the will.
Speaking of, if you are left a small insignificant amout of money in a loved ones will (usually $100 or less), know that you were "written out" in such a way that you can't come back and Sue the estate claiming they forgot you.
The land we deal with is typically part of a corporation (most farms and raches, at least here are set up that way. It makes partitioning the land fairly difficult.
