Trying not to jump to conclusions here but, this looks a little bit like someone is trying to push retail out of the crypto space. Accredited investors only? If that is the case, might want to get your crypto on a cold wallet, if you haven't done so already.

But the advice to go cold storage is prescient no matter the circumstances.

I think it's more that they're trying to push retail out of offshore scam exchange casinos and re-direct them into legacy US institutions that are opening up shop (ie fidelity).

I'm waiting for BTC to drop below $15k and then I'll buy on the way down...imo, the bottom will be between $9-12k...depending on what happens with Genesis/Gemini/Grayscale and the end contagion on exchanges...plus how the Mt. Gox repayment ordeal actually plays out...also how quickly Congress issues legislation/regulation .. that news will slow any drop occurring.

Imo, this is temporary...we will retrace back below $20k, how far is unknown but whales haven't followed their typical cycle antics of flooding the market with BTC, and scooping up retails fear, happens every cycle but hasn't yet., whales and krakens have not been accumulating


Edited: I'm assuming my old post resurfaced for 1 of 2 or both reasons.
1. BTC is climbing as folks claim we are now in a bull cycle although I believe it will drop (still do).
2. Mt Gox News was released where 2 largest creditors choose the payout option that does not require the liquidation of a large amount of BTC, retail sees this as bullish.

I hold firmly to my assertion that will drop below $20k and possibly retest the #15k support level, and ideally for me, hit a new lower low.

Thats an IRS question but I imagine that, due to its nature, BTC is more like a currency and will probably fall under CFTC jurisdiction and transactions in BTC handled just like other commodities and currencies.

Whats a decentralized smart contract?
It's a piece of code that automatically self-executes an agreement without an authority to demand such. Look up something like CRV. I think it's pretty interesting that protocols can basically perform eurodollar functions for anyone to participate in

based on what i know about CRV i'm confident that it's an unregistered security. proof of stake is going to be a big problem for ETH, and probably every ERC-20 token like CRV that is built on top of it except for maybe some stablecoins.

editing because you removed the bitcoin maximalist line, but my advice remains the same. focus on understanding the position gensler has consistently taken for the past couple years. he is not his being secretive about what he's planning at all.

Man the language gets caught quick. It's not an unregistered security becuase there's no identity to go after.

Look most of my portfolio is btc because there is value in a simple, digital commodity.

That being said, asshats like ginsler used to understand concepts like eth before he got corrupted.

Its been pretty clear for some time that all non-BTC vehicles would fall within the Howey test. The question is whether or not designation as a registered and regulated security will add legitimacy and broaden the investment pool or will compliance and management costs make the products non-sustainable.

I think you understand the issue at hand better than 99% of "crypto" investors (which would make sense given your financial reporting background)

CRV is the token for curve finance which is a company that was launched by a guy named michael egorov. there was a premine of something like 30% distributed to early investors. additionally the proof of stake mechanism itself most likely passes the howey test even without points one and two as gensler's position is that staking is an investment contract.

don't shoot the messenger but i think this one is pretty clear.
