Disclosure - not a lawyer so I have no clue what I'm talking about.

It's my understanding the injunction protects Sorsby / TT from any repercussions from the NCAA (and potentially the B12 depending on one's interpretation of tortious inference, or in this case I'd call it tortillas inference) until the trial takes place in Feb 2027.

The trial date is set for Feb 2027. Once we reach the trial date (whether the trial happens or not) - the injunction effectively expires, correct? Once the injunction is no longer in effect - is there anything that still protects TT from the NCAA?

The temporary injunction is probably going to be considered by the judge to last until a final judgment is issued at the end of the trial

But the temporary injunction is under appeal, so it could be dissolved by the appeals court before then.

the temporary injunction is specifically:

Quote:

IT IS FURHTER ORDERED that this injunction is effective immediately and will continue in force and effect until the signing of the final Judgment in this cause or until further order of this Court.

so it does not expire when trial is reached.

I see, thank you.

Once the trial is concluded though, what happens then? Seems like the only way TT comes out of this unscathed is if they win the trial, correct?

depends on what you mean by "unscathed" they seem pretty scathed to me already.

Usually, a temporary injunction through trial becomes a permanent injunction in the final judgment after trial. Now, if Sorsby is one and done at Tech, maybe he takes a nonsuit and the injunction is dissolved. Or, maybe Amarillo hears the appeal before the trial date and reverses (possible, but not probable).

In the court of public opinion yes their brand is heavily damaged.

From the NCAA's / Big 12's perspective though, they haven't faced any sanctions or penalties (yet). My question is - after the conclusion of the trial (pending the outcome), what's stopping the NCAA from enforcing heavy sanctions on TT?

Also not a lawyer. And I am a Tech fan, and one who is appalled by the posture our coach, AD, and admin are taking.

That said, here's how this is going to go down:

Sorsby brought the suit against the NCAA and won an injunction, not a verdict. The case is scheduled for February 2027 with the injunction in place until the case is tried.

Following the conclusion of the season, in January of 2027, Sorsby will drop the suit. That means there will be nothing for the NCAA to appeal. The NCAA will have no recourse against Sorsby. And because Tech would have acted under the instructions of the injunction, they may not have any recourse against Tech (and probably won't, based on this layman's reading).

At that point it remains to be seen if the NCAA will attempt to sanction Tech.

It will be interesting to see if the Big 12 steps in and warns Tech of sanctions, or if they wait to see what happens. As a Tech fan of 40+ years and a proud alum, I hope the Big 12 will insert itself aggressively to shut this down since the morons running my school are so eyeball deep in *****

Tech hasn't done anything wrong so far, but if Sorsby is allowed to play a single down, Tech will have crossed a line that should never be crossed.

I'm saddened and disappointed by the actions of my school thus far and I hope they change directions before the season begins.

Wonder how much of the 5 million Sorsby already has?
Is there some kind of moral turpitude clause in the NIL deal to not pay the money?
How long does it take to get a stay to reverse Sorsby being able to play until the actual trial
makes a ruling?

that brings up a whole other issue.

lets say this goes to trial (which I dont think happens) and Sorsby loses. If NCAA tries to go back and punish Tech or teams that played Tech, which they can do, then I think Tech etc. immediately file a lawsuit to prevent that, which I think they would likely prevail in.

interesting article for the law nerds

The injunction is on an expedited appeal. It will be reversed or upheld by Amarillo in the coming weeks.

How could Sorsby play this in the betting markets and guarantee himself a win. Is there a strainght up bet wether he plays or not? He could certainly manipulate a win.

If the lawsuit is dropped after the season or NCAA prevails, can the NCAA then vacate all of Tech's wins for the year?

In the gambling world, what are the odds that he will play?

That will be interesting to see. The NCAA was ordered in the injunction to not penalize Tech for complying with the injunction order, but Tech was not a named party in the suit.

as a Tech fan who doesn't want to see Sorsby play at all, I hope the Big 12 will step in as I don't think the NCAA can do anything based on my reading of the injunction and what I think will happen.

the whole thing sucks.
