Wife's 2007 BMW 335 got rear-ended last week by a dude in a Toyota pulling a trailer.

The guy:

1. is amazed that I won't let he and his buddies from Pasadena "weld a newer one on there"

2. refuses to believe that a late model BMW's bumper would cost $900 to replace, and

3. said (after I told him that I would be getting it fixed at a reputable collision repair facility) that "this is my wreck and I should be able to see that it is fixed under my terms."

Let's just say this guy isn't the sharpest tool in the shed, but is rather just a tool.

Oh, he has insurance (thank God he was driving a company truck) so it will get fixed the way I want one way or the other.

Similar thing with me, guy that shipped my boat up here (who also is tu alum) somehow lost my swim platform.
He's not very pleased out how much a ski boat swim platform costs. "I'm pissed man, I didn't think it would be that much" I reminded him that I'm pissed that my boat showed up without its platform. He tried to replace it with just a generic platform, I informed him that wouldn't fly. At least I found the OEM and was able to source the platform for half the cost the dealers wanted. 100% markup the dealers wanted to charge me, plus shipping.
It's been a headache to say the least.

I'm not encouraging insurance fraud, but often the fear of high medical payouts will help nudge the insurance company toward reasonable behavior in the property claim.

DO NOT SIGN the medical release until the car is right.

And of course, if you really do have medical problems, don't sign it at all.

We had a shot at Ervin Meyers while he was at Rhode Island or Utah. There was a daddy war bucks who wanted Fran. We got Fran , I am not sure of the years but Meyers wound up eventually in Florida and what we got was the shaft.
Does anyone know who was daddy war bucks? I do not believe it was Bum Bright.

I have no clue. My point was more toward resale down the road. When some fool hit my Lexus after it was a month old, I refused to take it anywhere but Sewell. So when you sell it, you can at least say it was done by XXX BMW dealership, even if they contract out the labor.

Full coverage - I take it in to the shop the next day file on my own insurance and let the insurance guys take care of the rest. get my deductible check in the mail later.

I did. They've contracted it out, but it's treated as though done by BMW.

Are you the same guy who backed into SWOSU-jr's Z71 and knocked off the Beemer's rear bumper? Beemer driver was talking on his cell phone and backed into the RanchHand front guard (not even a scratch on the RanchHand) while SWOSU-jr was refueling at a Valero in Austin. Beemer driver claimed that his backup camera didn't work right.

"Yeah, those backup cameras help a LOT if you don't pay any attention to them!"

Update:

Gave him two options:

1) Pay for it
2) I'll file on your insurance

He still maintained that I was bound by law to let him fix it himself and then accused me of trying to scam him by getting some body shop to quote an astronomical price ($900?...really?) to get it fixed.

This is what I get for trying to give him a chance to avoid raising his insurance premiums.

Oh, and he says his premiums wont be effected because "he'll just call his insurance company and explain that I wouldn't let him fix it."

Some people shouldn't be allowed to procreate.

I had an uninsured motorist back into my truck causing quite a bit of damage to the front end. When he said he wasn't insured, he said that he had money and to just get him the quote. Luckily I have uninsured motorist insurance and was able to get a rent car and repairs done. I still haven't gotten my deductible back as the insurance company is still unable to collect, 9 months later...

Just got a call from the company.

He cancelled his insurance not long before the accident.

...

I will refrain from ranting about people enjoying the benefits of the United States but not living up to their end of the bargain.

If its any consolation your insurance company has some options once your car is fixed. If he pays up they will send your deductible back to you. If not they can file to suspend his driver's license (if he has one). They can also file suit and have his wages garnished, if the damages are severe enough to warrant legal action to get back their losses.

Call his company and inform them that they have an uninsured driver using a company vehicle.

Wouldn't the company's insurance be primary anyway? If someone hits me with a company vehicle on company time, I figured it was the company's baby.

If nothing else, I figure this gives the OP two chances to recover damage, one from the driver, one from the vehicle owner.

I can't believe you even waited, you should have filed it under his insurance as soon as you realized what a major tool he was.

He tried to screw you, you need to put some heavy pressure on. Call his company. If you threaten legal action or have a lawyer call, they will probably give in to avoid the legal costs or get that lazy sob to pay you back.
