Sounds like if you don't like your neighbor set up a feeder next to their Dove field.

FYI had an incident on Saturday evening with a game warden not going to mention names or county . Sum may think I'm a complete dumb ass ! I was hunting a field on my deer lease at the front gate two wardens we're watching my friend and I from the road birds flew over I shot and got one it fell went to retrieve it picked it up and they pulled up to the gate . Not worried we did anything wrong I told me friend to unload his gun and they climbed over the gate and we walked towards each other they introduced each other and asked for the guns and three shells no problem then asked for our licenses I checked my bag and did not have my phone . I told him I needed to go to the camp hose and get it he followed me and we were talking I went into the house and got my phone he was looking across the other field looked at my phone said ok and handed it back . He asked me if that quail feeder was full and I said I don't know it wasn't mine he walked over and took a picture of it walked back and said you can't do that I said do what ? He said hunt by bait I said I wasn't I said I was over 200 yards from the feeder in anothe field separated by a tree line . I said I knew it was illegal to hunt by a feeder . He said it was illegal period and asked if we had deer feeders on the property I said yes he asked how many I told him I didn't know exactly but there we quite a few on 300 acres he asked if they we're throwing corn I said I'm sure so he said that was illegal to ! He said all feeders have to be turned off or empty for at least ten days with no grain on the ground prior to hunting migratory game birds on the property! Long story short we got tickets for hunting migratory game birds over bait even though we were not even close to any feeders and the birds were flying over and not going to the feeders in the front of the property! I didn't lie to them and told the truth on everything lesson learned have no idea what this is gonna cost I told him every piece of land in south Texas has feeders on it and I'm sure that they don't turn them off he said along side of hunters education tickets that was a close 2 nd . As ridicules as it sounds it's the law ! Sorry for the rant but I was shocked and never intentionally would brake the law .

I'd like to personally congratulate you on being an upstanding person.

If that were me, I'd be blasting his name and badge number along with county all over the place. Not that it would do any good. The law is the law and it's meaning is only as good as the enforcer who interprets it.

This is one of those laws that is less designed for anything useful and more designed for allowing a LEO to be an ass. That's it.

I wish the barriers to entry for jobs that have the most impact on people were at least a little more stringent. I am 100% certain that if you can't get a job doing anything else, LE is where you should look.

That fact is that he hates his job, probably had a bad day and you got to deal with it.

I've been dealing with a GW that got fired. What does it take to get fired from a guv job? Usually it's promotion time.

That sucks....I would fight it. The judge may rule in your favor regardless of the law since he law is very vague. Can he prove that birds were following a flyway to the feeder? At least make the ******bag show up for court. The quail feeder is one thing but if he didn't check the deer feeders he can't use them in his case.

Go on OnX and mark the feeders, your spot and the flight path and take it to court if you can show flight path wasnt toward a feeder - include the distances to the closest feeders

My issue with what happened to the OP is that hunting is a proud yet dying tradition. Ticketing people because it's the letter of the law does nothing to continue that tradition which creates jobs like game wardens.

My neighbor has been feeding his cattle hay since there is no grass left. After the cows clear out, there always seems to be a bunch of dove in the pasture where the hay was. Would this be considered a baited area?

You should be fine. We run into this issue sometimes hunting over rice and millet for ducks but as long as it's normal agricultural operations, it's fine. See below:

Kinda sounds like the GWs were there for a reason. Someone tipped them off a bunch of hunting/shooting was going on and they showed up.

Might not have even been you they were tipped off about.

But they wanted to do their thing…

Maybe it happened, I don't know, but any time I hear "not me, but my cousin's brother-in-law's nephew's best buddy" I start to doubt it.

I've read that before but in lots of sunflower fields for dove they're not actually doing any real production as far as I know. They just plant, let them grow, and then shred. Never been dinged for baiting in such an instance or for having deer feeders nearby.

Seems pretty subjective based on the GW's discretion and that makes me a bit uncomfortable.

Take lots of pictures of the area you were hunting, especially towards the areas where there "may" be feeders that "may" be in use.

Also print out a map showing your location relative to the feeder in question along with measured distances.

In the end its going to be the judge or JP that comes up with the fine and if you can show you took reasonable effort to hunt over an area you did not consider baited he can take discretion to minimize any fines

If it is this game warden you might be in luck!

Ridiculous. Should be mandatory that his sentence be doubled!

I mean, considering my bail was 10k as a 17 year old that blew a .16; these bonds are a joke.

Maybe we should get this guy to do some investigating of our GWs.
