Don't get roosters.

We technically can't have chickens in our neighborhood because the bylaws prevent it. Actually had one set of folks sell their place and move out a while back because they got tired of all of the restrictions. Seems most folks have no issues with chickens, but it takes a 2/3 vote of all property owners to change bylaws, and it is nigh impossible to get that many people to participate.

One of my neighbors has chickens, has had them for a while now. I rarely hear them and the have absolutely zero effect on my day to day life or my property value.

I used to have roosters. They got eaten. Chickens are quiet and generally not a nuisance beyond the occasional poop on the porch. And they are murder on flowerbeds, as they will scratch out the mulch looking for bugs and to make hollows to rest in.

Nothing in that is stopping you from having chicken. It specifically says they can make rules for poultry, but none appear to have been made.

You haven't shown anything stopping coops either. If they've approved back yard sheds or dog kennels, they have no leg to stand on.

I see nothing saying you can't build a coop or tractor. Go for it and tell the dude to piss up a rope if they have a problem.

Better yet, bring a copy of the guidelines highlighting both points.

Then bring photo examples of sheds and dog kennels in the hood they've approved. Then explain what happens in court if they don't follow their own guidelines. My guess is after pointing out they can't enforce rules that don't exist, it won't matter.

I would probably get my chicks from a hatchery that sexed the chicks before sending them. I don't want roosters, either!

Which is what most people do. Very easy and since it's the eggs you want and not more baby chicks the easy answer. If you were going to run your birds loose in a yard or a traditional farm yard setting then roosters help protect the flock and keep them somewhat together.

I watched the Prive Life of Chickens. It's a BBC show. Did you know a hen can turn into a rooster? It's still genetically a hen but it looks just like a rooster. It usually involves damage to one of the ovaries. Then, the testosterone takes over.

As someone who deals with HOA issues all the time it looks like you have an argument to have chickens. I would ask the HOA management company (not your neighbor) to send you in writing any rule that states whether or not chickens are permitted.

As for the coop, are you allowed to have any kind of backyard storage shed or small structure? Ask the management company for the specific guidelines. On one acre lots I'd be very surprised if storage buildings weren't allowed as long as they meet HOA guidelines.

Submit your "storage building" for approval without mentioning anything about chickens. Better yet, get the building approved before you ask the management company about chickens. Keep the two issues separate.

Design your building so it truly can be used for storage (and of course chickens). Get yo' chicks. Profit! If they hassle you you've already got your paper trail from the HOA.

I've been wanting chickens for a long time. Backyard chickens are not for saving money on eggs. They're super expensive eggs.

Ok…..I can appreciate that, but there is a sudden surge in people thinking they're going to save a ton of money on eggs by hitching themselves to some back yard birds, and I didn't want you to make the mistake.

Easy, don't have a coop, just let them free range… what's the problem?

My guess is after a few weeks the HOA would make it mandatory to have a coop.

Neighbors across the street have a chicken coop and we take care of them when they're out of town. Seeing raccoons in the back yard at 5 pm when I went over to feed them and make sure they're in the coop before the Sun went down became so common, I started taking a .22 pellet gun over and shooting one each trip.

No coop = dead chickens

We've got some friends in the Heights (Houston) that had a couple of wild guineafowl take up residence in their front yard bushes. They said they are now family pets and produce pretty good eggs.

I called the HOA mgmt company yesterday. Of course I had to leave a message and still haven't heard back from them. I called today and they were all "at training". I'll call again tomorrow.

I'm planning to drive the neighborhood with a camera and take pics of all outbuildings I can see from the street. Not sure what I'll be able to get. Big wooded lots might mean I get nothing.

Good luck. I've gotten legal threats from our HOA for a shed I never had (they had the wrong address) and for "mold" that ended up being shadows from the ****ing trees.

I was going to say the same thing. In this case, I would proceed and then ask for forgiveness if it raises the neighbors hackles.

Nope. It will be ignore and hope it goes okay.

If you actually want something from them. Link the excerpts with the rules in an email and ask for confirmation that nothing stops what you are doing in writing by email. Remind them they can only enforce written adopted policies.

My experience is that is generally what happens. However, the more written communication (even if it is just you spelling that out before doing) saves you later if they try and be jerks.

1 email attaching the rules stating you don't believe it conflicts with any rules and requesting them to confirm within 7 days. And a second email with supportive photos and addresses of other similar structures make them taking you to court very difficult.
