It's my understanding that in Texas a city or municipality can't prevent you from keeping 6 or fewer chickens… but an HOA can. Is that correct?

I was hoping to get some chickens but my neighbor, who is a member of the ARC, said they are not allowed. I've read restrictions and I don't see that the chickens are prohibited but I can see that a coop could be a problem. Our yards are not fenced (and I don't want to fence my property) and he can see my whole yard. No way I'm sneaking a coop onto my property.

Is my understanding of the law correct?

The mayor where I live is one of my friends. This issue recently during our local Dad's group beer drinking sessions. He said it also gets brought up with Cory council frequently. Your understanding of the law is correct.
One other thing is that my HOA prohibits them but there are a couple of homes that have them because they had them before the HOA was established and those properties are grandfathered in. My buddy said if those proposal, the new owners can have chickens too because whomever wrote it up, listed the property address as being exempt and didn't write in any other exclusions such as changing ownership

I can't sneak quail in, either. HE CAN SEE MY ENTIRE BACK YARD.

I think HE doesn't want chickens next door. I don't think chickens are outlawed but the coops won't pass ARC muster. Even a really nice one.

Have you seen Centerpole's coop?! I wouldn't want to live in a neighborhood with an ARC that wouldn't approve that. Hell it's nicer than my house.

Surely there's a way around this. If chickens aren't specifically forbidden then you have a starting point. Perhaps a coop disguised as a greenhouse?

Easy, don't have a coop, just let them free range… what's the problem?

My guess is after a few weeks the HOA would make it mandatory to have a coop.

Yeah. But you're forgetting the joy and personal satisfaction achieved by pissing off someone on the HOA. Can't put a price on that.

Technically my hoa bans "farm animals" without any further definition. I assume that means that they don't want horses or cows, because I have 6 free ranging chickens, meat rabbits and a show lamb and nobody has said anything to me. That said, I don't have any neighbors for within a few hundred yards in any direction

We are on an acre, and the place I want to put the coop isn't visible from the street... but he'll be able to see it from his backyard. However, it is probably at least 100 yards from him. If he wasn't a member of the ARC, I wouldn't be worried about it. But as it is I know he'll rat me out. He's complained a lot about the house behind us that was under construction until recently.




Nothing here prohibits chickens. It's the coop that's the problem, I think. Section 3.07 A.5 just says the board has the right to enforce the rules by any "legal and appropriate" means necessary.

By the way, he was really fast to tell me it's not allowed. However, when I asked him where in the deed restrictions it is prohibited he did not respond at all. I am still waiting on him... I told him I was only asking him because he was a member of the ARC.

Permanently connect coop to back of the house and get approval from HOA as an addition. No "coop" no problem

I raised them for two years about. It was really good but nobody in my family would help me so I gave them all away

Architectural Review Committee.
They're like NARCs, but for HOAs. Also known has the pinnacle of lifetime achievement for your local neighborhood NIMBY.

On a serious note. They are tasked with reviewing homeowner requests for whatever the hell your particular HOA requires approval for and making sure it complies with the HOA guidelines. Or if you live in my neighborhood they are responsible for making up whatever the hell rules they feel like and encoding them into an ever increasing 18 page book of rules and regulations that covers everything from the size of ****ing birdhouses to the design of your replacement front door.

Needless to say, I wouldn't take a leak on a burning HOA member.

In my case, literally. They basically decide if you can build something on your property. I generally am in favors of HOAs. However, having Mr. NIMBY ARC member as a neighbor is going to be a problem for me and my planned chickens.

My very vague understanding was that this was a relatively new state law that passed (within the last 2 or 3 years) and that it would circumseed HOAs or ARCs.

Similar to being able to park on a public street regardless of whether or not the HOA says no parking on the street.

Can you build it on the side of your house that he cannot see, or is he directly behind you? You could put up a small fence that blocks the view of the coop if you put it directly next to your house.

Being on the Board of my HOA, I am under the impression that if State Law allows anyone to have chickens, there is nothing an HOA can do legally to prevent it. We have multiple people in our Subdivision that raise chickens for eggs and the only restriction is that they have to be restricted to their lot.

I would go the other way and bring it up to the HOA board at a meeting and get a change to your HOA bylaws specifically approving chicken coop's as long as they meet certain guidelines, size, constructions, ect.

Owning backyard chickens is at an all time high and very popular right now. I would imagine you would get support from a bunch of folks in your neighborhood and the board should respect that. They have to get elected after all.

The other option is go with a chicken tractor setup that you move around your yard. Just don't leave it in one place for more than two days or you will end up with a patch of bare dirt. If it's not a permanent structure then the ARC guy has no say and if it doesn't violate any other HOA bylaws then you should be good.

I have seen folks create a chicken "coop" under a trampoline.... Not the prettiest thing but might get you around the arc rules.

Just thinking out loud here…

If the permanent nature of a coop is the real disqualifying element - what about a chicken tractor? Since it's not permanently located in one place is it anymore offensive than any other big backyard item like a trampoline or swing set???

ETA - take 20 min to work and answer the phone and hack out a post - and you're late to the party…. I agree with the posters above.

I don't want to become a hated member of the ARC.

My subdivision prohibits "temporary structures" of any kind with the exception of kids' play sets.

Permanent structure have to meet certain guidelines that would probably make a chicken coop cost-prohibitive.

I live on a corner lot and anything he can't see from his yard will be visible from the street.

I have called property management company for clarification. I would not put it past NIMBY guy to tell me they are not allowed because they don't want them next door.

Our board is soliciting applications for new members… I may consider joining board.

This happened in my hood with our ARC a few years back.

Except it was to override the "no" vote from the existing ARC so the president and two of his neighbors could build metal buildings that didn't meet the guidelines because they got a discount from whomever the contractor was to build them one after another and exactly the same.
