email I got today. I don't usually opt into class actions but I feel like I got hosed. $20 is better than nothing

  • Costa Del Mar, Inc. ("Costa") settled a class action lawsuit related to whether Costa improperly (i) charged more than a "nominal" fee for repairs to Costa sunglasses damaged by accident, normal wear and tear, or misuse, and (ii) charged fees for warranty repairs on Costa sunglasses backed by a "Lifetime Warranty."
  • You may be entitled to receive one or more Product Vouchers between $8.99 and $19.99, based on certain eligibility requirements discussed below.
  • Please read this notice carefully. Your legal rights are affected whether you act or don't act.

Florida Repair Class
All citizens of the State of Florida who:
  • purchased Costa plano sunglasses before January 1, 2018; and
  • were charged a fee by Costa, from July 28, 2012 through the date of entry of the Court's Final Order, to repair or replace their Costa plano sunglasses damaged by accident, normal wear and tear, or misuse.
Nationwide Repair Class
All citizens of the United States (excluding citizens of the State of Florida) who:
  • purchased Costa plano sunglasses before January 1, 2018, and
  • were charged a repair fee by Costa, from April 3, 2015 through the date of entry of the Court's Final Order, to repair or replace their Costa plano sunglasses damaged by accident, normal wear and tear, or misuse.

Warranty Class
All citizens of the United States who:
  • purchased non-prescription Costa sunglasses prior to January 1, 2016; and
  • paid Costa a warranty fee to repair or replace non-prescription sunglasses damaged by a manufacturer's defect from August 20, 2013 through the date of entry of the Court's Final Order.

I got it too.

$20 check I could see myself not even looking for and trashing.

$20 product voucher is even more worthless....have to spend $100+ to utilize unless i guess someone were to go buy glasses cleaner, case, etc...

Same here. Got that email yesterday, didn't feel it was worth the time to fill out whatever they needed and send it in.

next time you guys see a $20 bill on the sidewalk and decide it's not worth your trouble to bend over and pick it up, do me a favor and let me know where it was?

I read through that email also and from my interpretation you don't have to opt IN. Just opt OUT. The way I read it, they will send you the money or voucher or whatever regardless (minus one of the Florida repair or warranty groups).

Anyone feel free to correct me

Also won't be final til spring 2021 at the earliest so this could be 8-12 months from now before we see a dime

LOL. We are in a pandemic. Could have COVID cooties.

I would gladly take cash but the voucher is far less enticing. Will make me spend more than I get. Probably a win for Costa.

Thought I would post an update on my recent experience.

I had a pair of Zane 580P with blue mirror purchased in July 2017.

Glasses started to get a little scratched but were still good enough. Recently the rubber tips at the end fell off and the plastic wrapped around started to fall off.

1/7/21- submitted warranty claim
1/8/21- received confirmation that frames were covered, received prepaid shipping label, and shipped out
1/12/21- damaged glasses received by costa
1/19/21- received same model replacement

I was not charged any fee and received same model replacement.

I know not everyone's experience has been this good, but I'm pretty happy with the outcome.
