Gotta disagree with this. The perp is on your property, and he doesn't have to enter your house to steal something. He could have stolen the doormat, as trivial as it is. It's still stealing according to the law.

I'm not actively suggesting you need to blast someone that is on your property. What I am trying to point out is that the law is written to give the benefit of the doubt to the victim. There are plenty of grey areas in there that give justification to the victims actions.

Why would you shoot some scumbag who is fleeing with something they took off your porch? Surely your yard art covered by your home insurance. I REALLY don't want to have a life on my conscious unless I'm saving my and/or my families' lives. Certainly not worth having do deal with that, or the legal issues that come along with it, unless it was a life or death issue. Nothing I own is worth killing someone over.

as with any self defense situation argued over the intertron, no amount of typed words can ever fully describe the nuances of the situation. So to base a hypothetical reaction on a hypothetical situation that is severely lacking in details is futile.

This leaves us arguing larger picture sub-situations, and having others extrapolate those views to other sub-situations for sake of argument.

For instance, in response to isleags comment: I dont want to have to shoot and kill someone either. But at the end of the day it is either me or them, and I would like to think that I am mentally and physically prepared to protect my soul. This said, if the situation reveals itself as a some punk kid stealing my lawn gnome, deadly force might not be appropriate. If I get the feeling the guy kicking in my front door is so brazen that he might attempt to return when I am gone and my wife and child are home alone, well...



This is why i asked the OP if the guy kicking in the door thought the house was empty, or was he kicking it in knowing people were inside. If he was kicking it in and knew people were inside, I feel the threat must be stopped. That threat extends beyond the immediate present in my view.


You are correct that property is of less value than life. But evil has no morals; and evil must be fought on a level playing field if the just individual is to stand a chance.

I hate it when you go to post something rather lengthy and you lose the text you've written and it brings up the login screen again, even though you already logged in, with no way to recover what you typed. UGH.

The short version:

Log: sure, the perp could have committed theft without entering the house, but based on the facts presented here, I wouldn't risk it.

The decision of a jury in west Texas could differ from a jury in downtown Houston. I hope posters make their decisions based on what the least favorable jury pool out there may decide.

I think this is where I don't agree... if a bad guy is fleeing, it is no longer "me or them" in my eyes.

I agree that he might come back... but taking it upon yourself to shoot him in the back after he tried to kick in your door, failed, and ran, because he might come back is not justice. There are a bunch of things he might do when he gets in his car and leaves.

dlance - I try that when it happens, but half the time it doesn't still have the text in the box. I try to copy my text prior to hitting submit just in case, but didn't this morning.

It seems to happen more when you have two windows open with the thread.

as for loosing info after typing: if you hit submit and it pops up a login screen, do not log back in. instead, page back, copy, then log in, then paste and submit.

Every situation is different. No two are ever the same. Body language and how you (collective) interpret will be different from person to person. You (@isleag) make the assumption that if I think the badguy will return, I will shoot him in the back. I dont even know that. Nuances and body language and inflections and words make the situation what it is. Every case is different and demands a logical mind to quickly analyze and form a solution.

I offered my, "me or him" comment on the sole premise that the comment is my foundation. It is what I stand on. All decisions are based on it. Now that doesnt mean all situations demand I make the choice "me or him", but rather that if all other dichotomous tree questions have led to it, it is the ultimate and final question that I absolutely know the answer to.

I agree with you 100% about this. Some folks around here, not you, just seem a little eager to shoot someone.

I love these threads because it makes me think about various situations and how to handle them.
