Not sure this is the precedent these judges want to start setting. Turnabout is fair play. Same goes for Booker and Kim. We all know how well reversing traditional course worked for liberals when Harry Reid started down this path.

Judges vote against extending Alina Habba's term as US attorney in New Jersey

Oddly enough, there are higher qualifications for US attorneys.
Maybe she could have benefitted from not going 0-fer each time she represented Trump.

I was today years old when I first learned that judges had this power over US attorney appointments, and that the Senators from the state can block a nominee from even being put forward for a US attorney position in their state.

I had no idea.

She was an interim US attorney and I guess the judges have the ability to block the extension of the interim status but not the appointment.

Blue slips have been by both parties to block nominees for Senate confirmation.

Not sure I like this move. As I understand it, Habba is hopelessly blocked from confirmation by the NJ Senators' blue slip. So that means the judges can just appoint someone else?

The NJ Fed judges need to stay the hell in their lane and let the administration do what they were elected to do. If they want to play this game, keep appointing interims that will drive liberals nuts more than the one before. The Judiciary needs to knock this **** off.

The law flat out says they can do this after a 120-day term expires.

Certainly there could be good reasons to leave a person in place, competency being a good one. "Because the president wants this person there" is not a good reason.

Regardless, I don't think it matters, because it looks like he can re-appoint Habba.

I'm tracking with you on this one. Apparently this is all a matter of law and/or constitution. The district judges have the legal right to appoint an interim attorney after the first interim expires. No different than a governor appointing a replacement representative to Congress until an election is held. Or the president appointing an interim attorney or agency head.

If somebody wants to get riled up about this, it's the Senate tradition of allowing an in-state senator -- whether from a blue or red state -- to block a president's state attorney nomination. That's total BS. The full Senate needs to vote on it straight up or down. Save our democracy, as they like to say.

Dems fell into the trap on this one. Habba is hot but a terrible lawyer that went to a joke of a law school and was cringe in her legal arguments for Trump. She's great on TV though and will play the role of martyr very well. This just gave Trump some great ammo and he now can actually replace her with someone that is a real bulldog and actually understands the law.
