Wow. Abrego-Garcia is your example. So he was misidentified as an illegal but had a legal right to remain in the US? Because that did not happen.

He "supposedly" had a valid "do not deport to El Salvador because rival gang members will kill me an my family" though it actually said Guatemala. Regardless, he should still have been deported. Now the wife beating, sex trafficking, human smuggling, gang banger Marylin father, union member is going to get to waste away in our jails and STILL be sent back to El Salvador to face punishment for his crimes there.

But yea, lawd the government got it wrong.

Why don't they just give them all Covid vaccines and let them walk off and eventually have heart problems or die - it's easier and less obvious than deporting them.. this is what my friend is saying we should do - lol

Try reading the constitution. It says otherwise.


The Constitution says no such thing. That's how the Constitution has been interpreted by the courts.

Non-citizens (legal and illegal) do, however, are guaranteed in Article III free use of the federal court system.

The Constitution says no such thing. That's how the Constitution has been interpreted by the courts.

Non-citizens (legal and illegal) do, however, are guaranteed in Article III free use of the federal court system.
There are clauses that use "citizen" and others that use "people." As long as that remains true, undocumented's will have rights granted by the US Constitution.

Yea, those cases are very unique (and somewhat bizarre)

First guy waits 10 years after being deported to obtain a Massachusetts birth certificate, granted a passport, returns to US then waits another couple of years to file a suit.

Since Señor Mañana was never in a hurry, we don't get the facts as case was dismissed. There is also mention that at some point his passport was revoked. This one is on the deportee for being too lazy or too dumb to provide evidence of his citizenship… with the potential that he may not be a citizen.

The next two involve diminished capacity individuals who for whatever reason were unwilling or unable to provide details of their citizenship. Given the low amounts of the settlement, it would seem that the cases were not as egregious as being insinuated. However, both of these involve individuals who committed separate crime(s) that put them on a path that resulted in deportation.

I suggest if you are unable to comprehend how to explain to ICE you are a citizen, then maybe have a copy of your birth certificate safety pinned to your dungarees if you plan to assault someone or steal an airplane.

They're illegals, not undocumenteds. And the right to remain in this country is not one of the rights they are granted.
