Detained activist Mahmoud Khalil filed a lawsuit Thursday against Columbia University and the House Committee on Education and the Workforce to stop the school from giving student disciplinary records to lawmakers.
Khalil, a former Columbia student who was arrested by Immigration and Customs Enforcement (ICE) after playing a leading role in pro-Palestinian demonstrations, is suing alongside other students after the House committee sent a letter on Feb. 13 demanding student disciplinary records from certain incidents on campus, saying the school would risk loss of federal funding if it failed to comply.
The suit is seeking declaratory and injunctive relief to stop the transfer of any more records until a decision is reached by the court.
"The Committee's Letter is clearly intended to chill the protected speech of University's students," the lawsuit reads.

Bbut his attorneys will mount a vigorous defense to the constitutionality of the provision being employed by the Trump Administration to deport him -- the authority given to the Secretary of State to determine that Khalil's continued presence in the US would be detrimental to the foreign policy of the US. Such a challenge on constitutional grounds comes after the immigration proceedings are concluded and result in a final Order of Deportation.
So, in order, here are a list of things I expect to happen over the new few months with predicted outcomes:
[ol]SDNY Judge rules he lacks jurisdiction and all proceedings on pending habeas petition must happen in Louisiana. Louisiana judge will deny him bail, and he will remain in detention pending the outcome of all deportation proceedings. Order of Deportation will be entered by Immigration Judge. BIA will deny his appeal of Order of Deportation. Fifth Circuit Court of Appeal will deny appeal of BIA decision. A new petition for writ of habeas corpus will be filed challenging constitutionality of INA provision giving Secretary of State discretion to declare that an alien's continued presence in the US is contrary to US foreign policy. [/ol]The Trump Administration is likely to follow on with deportations of protesters who are holders only of Student Visas, and allow Khalil's case to be the only "test" case on the use of the Secretary of State's authority to deport a permanent resident alien.
