Judges, judge shopping themselves?



The Global Health case assigned number 25-cv-00402, and the AIDS Vaccine case was assigned number 25-cv-00400. The implication of the case numbers is that the two cases were likely filed at the same time on Monday, 2/11/25.
The Global Health case was assigned to new Biden appointee Judge Loren AliKahn, and the Aids Vaccine case was assigned to Biden appointee Amir Ali.

When new cases are filed and the parties know the cases are "related" by their subject matter to a case already filed in the District, a "Related Case Notice" is supposed to be filed along with the new case. All three cases here challenge the POTUS' authority as alleged in the the same EO targeting spending by USAID.

Global Health did not file a Related Case Notice with regard to the case before Judge Nichols. For obvious reasons based on his earlier comments, they didn't want the case moved away from Judge AliKahn.

But the DOJ did file such a notice. When DOJ did so, Global Health then filed a "Response," noting that the AIDS Vaccine case was also "related" in that it challenged the same EO as the American Foreign case before Judge Nichols.

When there is a Related Case Notice filed, the Local Rule provides as follows:

"Where the existence of related cases in this Court is revealed after the cases are assigned, the judge having the later-numbered case may transfer that case to the Calendar and Case Management Committee for reassignment to the judge having the earlier case."
Note the case numbers:

American Foreign Service Assn -- 22-cv-00352
Aids Vaccine -- 22-cv-00400
Global Health -- 22-cv-00402.

Curiously, the AIDS Vaccine case was also originally assigned to Judge AliKahn, and she issued a "Show Cause Order" directing the parties to take a position on the "Related Case Issue."
The DOJ did so, noting the overlap of the three cases with regard to the same EO and a challenge to the authority of POTUS to cancel USAID funding. The DOJ also noted that the same Plaintiffs' counsel was involved in both Judge Nichols case and the new AIDS Vaccine case. DOJ asked that both new cases be transferred to Judge Nichols.

Rather than do that, Judge AliKahn requested that the AIDS Vaccine case be randomly reassigned by the Clerk's Office. That is how it ended up with Judge Ali. Then she transferred the Global Health case to Judge Ali as well since the AIDS Vaccine case had the earlier-issued case number between the two -- likely filed at the same time.

Basically, she avoided either case going to Judge Nichols who had already indicated an unwillingness to block the EO issued by President Trump.

In other districts where I have practiced the issue of related cases is left to the Judge who was assigned the first case to decide, not the Judge who was assigned the later case. So, in this circumstance, it would have been Judge Nichols who decided whether he should

Sounds like the judge will go with the plaintiffs. Not real surprised.



Hopefully Trump's team can convince the circuit/SCOTUS to treat it like an injunction and seek mandamus relief. Seems like the communists are once again over-stepping, just a matter of how far out of bounds the contact is made.

Glad he's got Elon's back and talking about how they are chattering about him. One thing though -- why announce such an intention a day in advance? Seems like the kind of thing you should just spring out as a revelation so there is no counter-measures (or even flights from the country)

IIRC, Levin mentioned on his show either yesterday or Monday that he thought the President was looking tired and that he hoped he was feeling OK.

Hell, I wouldn't blame Trump if he were tired. That guy works like crazy, and he's 78 years old. He's damn sure not falling asleep in his easy chair every day at 4:30 PM watching Gunsmoke reruns, that's for sure.

My side note -- it looks like he's found his JFF in Elon. I hope it lasts.

Not if it isn't funded…I'm not so sure the spigot will be turned on, and even if it were to be, something tells me DOGE could forensically pinpoint where the funding came from and who was responsible for cutting the check…

They rooted out the FEMA payment for illegals in hotels pretty damn quick and identified the perpetrators, outed them, and then fired them…

I think DOGE has set some traps in the system to identify any misuse of funds moving forward…

Doge is using AI on government databases to look for wasteful spending- looking at budgets, contracts, outgoing cash, etc.

A well-timed outrageous incident (ie - white supremacy + guns) could fire up the masses that these dem politicians are trying unsuccessfully to fire up now. That happens, and outside of gov funding can pour in to really make it "fiery but mostly peaceful". DOGE has no role if that happens. DOGE is computer science nerds on government databases.

- politicians, bureaucrats, and their Pravda media arm want people to be up in arms about DOGE now. But they're not. Deep state can't pay for enough outrage right now because their expenditures are being watched. But they could still create an incident and find a way to really make people care. Just need a martyr like St Floyd.

Remember that a divided population is easier to control. Marxism 101. The state will make sure the division continues and worsens.
