If you've waived speedy trial requirements, it can take that long, especially in federal cases. And, there's lots of ways to get around the speedy trial requirements.

Of course. The presumption is that bail should be permitted, unless there are circumstances that would prevent that. But some were held without bail because of individual circumstances.

I want to know which ones weren't afforded a bail hearing.

Still should have gotten bail. With the way bail reform is in some states they would be released with no bail.


I think no bail should be saved for murder or sexual assault. Things in that realm I see no bail. Assault and destruction of property even if it's felony should get bail. The exception I would say is repeat offenders or people that are likely to flee.

Even an "assault" of an officer or destruction of property should be afforded an opportunity for bail. Contrary to the narrative of the left and the MSM, this was not on the same level of 9/11 or Pearl Harbor.

90% of those incarcerated are guilty of nothing more than trespassing. Four years of incarceration, many without a trial, for trespassing.

What about those who have been arrested who never entered the capitol??? They were just there watching and have since been arrested.

That's probably a good compromise standard. If any `violence' is only against inanimate they are more likely to be reasonable about not abusing bail or further escalating if you give them some slack till case can be examined. If you think the damage was particularly willfull, just make the bail more costly and so forth.

A major exception would be a broad based violence like forest arson endangering neighborhoods like L.A. apparently has had to deal with.

Rapists and murderers sometimes serve less time. And he was right. Hardly anyone served any time for the 27 people murdered and over 700 policeman injured or attacked during the 2020 riots.

Most of the J6 people were denied due process.

You're full of ***** Every one of them was afforded a bail hearing. It's one of the very first things that's done in a case. No one sitting in jail for four years hasn't had a bail hearing. Whether they were properly denied bail is another issue.

I don't know. There are factors, flight risk is one of them. But you'd have to look at each individual case to find out why. And I'm not doing that for you.
