The Hill is still living in pre-2024, thinking that the majority of the country is opposed to Trump being President.

14th amendment crap again. So stupid.

But here is a scenario that I fear is more probable and it involves Mike Johnson. he did himself no favors with that budget debacle last week. Jefferies has already said the Dems won't come to his rescue for retaining SOH if some Republicans defect on Jan 3rd. No Speaker three days later on Jan 6th? No certification.

No Speaker after 14 more days to January 20th? Biden is gone, Kamala is gone, Trump can't be inaugurated without certification, still no Speaker, so who becomes acting President? Chuck Grassley as President Pro Tempore.

Agreed. Seeing that the authors are advocating for overturning an election in favor of a power grab on the flimsiest grounds imaginable, I would argue that they themselves are "inciting insurrection against the Constitution".

A couple of years of incarceration should be in order for them to rethink their actions.

One of the authors is from Cornell Law and the other from Yale Law. Why does that not surprise me.

The arguments are incredibly laughable.

Trump can be disqualified under the 14th Amendment because:

1) A majority of the Senate, but not 2/3, voted to convict which means Trump is guilty of insurrection. Similar to a jury having a majority to convict in a jurisdiction where a unanimous verdict is required would make someone guilty. Oh and Trump had counsel for that.

2) In the Colorado hearing he was found to be guilty of insurrection in their attempt to throw him off the ballot that was then overturned by the Supreme Court. So if a court is overturned you're still guilty. Trump also had counsel.

3) The J6 inquiry found he was responsible for an insurrection. Trump didn't have counsel. It was bipartisan of course. Any mention of members of the committee being referred for investigation or prosecution for destroying evidence, witness tampering or suborning perjury? Yeah not mentioned.

So that means Congress can vote to ignore Trump electors.

This wouldn't pass muster in a pre-law class let alone a moot court. What an embarrassing argument to attach your name to having graduated from any law school let alone some prestigious ones. It's as shallow and intellectually as lazy an argument as you will ever see. I'd expect better from a 1st semester 1L.

Yet, John Eastman made a logical argument regarding alternate slates of electors to comply with the Safe Harbor provisions in 2020 and has been disbarred over that. Eastman's proposition certainly had more historical and legit legal analysis than The Hill's bag of crap arguments.
