That "Challenge" would not go far as there is nothing that requires specific crimes to be delineated.FrioAg 00 said:
I'd like to see the constitutionality of these "blanket pardons" without specific crimes being numerated challenged. It's unprecedented, there is nothing in A2 specifically supporting it, and it's easy argued as large leap beyond the plain interpretation of the text.
While the scope of the pardon, 10 years, is unprecedented, if you look at past pardons for un-convicted crimes, they don't name specific crimes. And there is good reason for that. With so many laws out there, the Feds could easily find a way around the pardoned crime and find something else in the USC to charge the person with.
Now, Therefore, I, Gerald R. Ford, President of the United States, pursuant to the pardon power conferred upon me by Article II, Section 2, of the Constitution, have granted and by these presents do grant a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from January 20, 1969 through August 9, 1974.
Now, Therefore, I, George Bush, President of the United States of America, pursuant to my powers under Article II, Section 2, of the Constitution, do hereby grant a full, complete, and unconditional pardon to Elliott Abrams, Duane R. Clarridge, Alan Fiers, Clair George, Robert C. McFarlane, and Caspar W. Weinberger for all offenses charged or prosecuted by Independent Counsel Lawrence E. Walsh or other member of his office, or committed by these individuals and within the jurisdiction of that office.
It does suck, but he does have that power!Quote:
If Biden wants to pardon Hunter he should be able to, but I don't believe he has the authority of pardoning him from being convicted of all potential crimes for a 10 year period of time.
What I'd like to see happen, but doubt it does because Trump DoJ has bigger fish to fry, is for Hunter to be charged with the crimes. Make him assert the pardon.
