A woman in Georgia tried to evict a squatter and ended up going to jail.

The crazy justification for being easy on squatters seems to be that they have tenant's rights that are being illegally violated by the property owner.

In this case, the squatter was the daughter of a previous partner who had already been evicted.

However, a judge ruled that Johnson was not a squatter due to her relation to a previously evicted tenant's partner.

"How can she not be squatting when I've never had any type of contract relationship with this person," said Hale to WSB-TV 2.

Body camera footage from the sheriff's department captured a deputy advising Hale to consider the alleged squatter's perspective, noting, "Everybody isn't as fortunate as you to have a bed."

According to WSB-TV 2, Hale was charged with criminal trespassing and a misdemeanor count of terroristic threats. The alleged squatter was not charged with any crime.

I think that the deputy's remark says it all -- he is clearly saying that the squatter has the greater right to the home because she is less fortunate.

What a pathetic world we have created.

Of all the idiocy this country puts up with these days. From transgender nonsense, to letting men play in women's sports, to opening the borders and paying for illegals to sleep in five star hotels, putting up with squatters or allowing them to have any rights at all, is by far the most infuriating. I think you should be able to shoot and kill squatters the same way you could anyone else breaking into your home. Just infuriating..

One squatter in Panama City Beach, Florida got 40 years in prison last July.

This one didn't simply move in, he forged documents to transfer the property to himself.

I'll never own rental property for this exact reason. Had a friend in Austin that took almost a year to get a non-paying tenant evicted and had to spend thousands of dollars for the privilege

I would have immediately asked the deputy for their address so I could send some less fortunate " Unhoused " stellar individuals to his house. Which obviously, he would have immediately shut that sh*t down as an option.

If I ever have a tenant I can't eviction through legal means, the plan is to fight fire with fire. My plan, if the law fails me, is to higher someone, pay them to be my tenant, sign a lease, have them move in and make their lives in that house unbearable. No sleeping, no food, no peace. The only people who can legally do that is another tenant. Fortunately, I know a guy.

One thing I have wondered is if you could buy a house under a trust and then lease the house to you. I assume that you would then be a tenant and if someone tried to claim that they were a tenant, you would be the one with an actual signed lease and could stay and be as obnxious as you can legally be to make it so uncomfortable for them that they have to move.

I've asked this several times but nobody has ever explained the issues.

I suspect that one issue is that the trust would probably have to pay taxes on the income it got from your lease payments. That could probably make it not worth the cost.

Probably cheaper to lease it out to someone else.

Just squat on the property. The squatter will have more claim than the leasee.

I used to own rental properties but got out some time back. It just took one bad tenant who took over a year to get rid of that ate up all the $ and then some I would have made on that. And decent tenants were getting harder and harder to come by already.

To recap, the squatter, who lost in court, called the police and claimed breaking-and-entering/trespassing against the owner in her own house. And this was AFTER she won in court.

Why tf do you need a 'writ of possession' to 'legally evict' a squatter? Nevermind you already won a court case, you're not 'evicting' someone who never had a contractual relationship with you, you're removing a trespasser from your own property.

Freaking clown world there in Georgia.

Bought a small apt complex in July.

Not renewing any of the leases and remodeling.

Have three tenants left. One is a lunatic and I'm 100% sure I will have to evict her and her adult daughter.

This weekend she fired off a demand letter and I've forwarded it to an attorney. Merry frig'n Christmas to me! I hate these people.

There is a guy that has a business of squatting on squatters. They can't get him out either. He has a rental agreement with the homeowner and it uses the iodic of the system to kick out the squatter

We had a rent house in college station, never doing that again. Two 20 year olds lived there, dropped out of A&M and refused to leave. Took way longer than it should have to get them out.

If I was a landlord and found squatters occupying one of my properties I would just go to a biker bar and pay some Hells Angels or Bandito motorcycle gangs dudes to move in with the squatter for a weekend and see what happens.
