This. I've seen folks try to argue that the 14th amendment doesn't include children of non-citizens (based upon the "...subject to the jurisdiction thereof..." clause), but I don't buy it, except in the case of diplomats and foreign combatants. But, given the case law up this point, and in order to not disturb folks who came here before Biden opened the borders, I think I would word the amendment so that a person born after January 1, 2020, in order to be a citizen of the United States, must be the child of a US citizen or must be naturalized.

Given that Trump ran on closing the border in 2016, and became POTUS on January 20, 2017, that would be the better cut off date. Assumption of the risk.

They have been sending kids who are barely able to walk or talk across the border without an adult. And how is that our fault?

Go back to old bracero program. Let them stay and when season is over, send them home.

And they would go north and work fields in cool summers and then come back to RGV with crap load of money and not work all winter.
Tell me where that is cruel? School was a problem, but we set up a migrant school from Oct- April with more classroom hours- oh how cruel!! Now, you could set up tri semester and not lose beat and put them on computer courses.
Why lots of them liked the life! Horrors say the libs!

Braceros program worked with housing, food, wages and was supervised for living conditions.

But you know who complained the most about it? Mexico. They lost their agriculture worker base.

Khou is starting their stories about families being separated due to deportation, which is the first of many more to come.

The parents made conscious decisions that led to this situation. As far as the father being "separated" from the family, they also made a decision for him to stay and not accompany his family back to Mexico. Nobody stopped him from going. Again decisions have consequences.

Nothing new to see here.
And many still do the same thing in 2024. Not every worker from south of the border wants to be a tiny American flag waving citizen, and our green card system needs a massive overhaul to allow for this without all the red tape, time, and expense.

It has been argued that foreign citizens are under the authority of their own national government and not under the authority of the U.S. government insofar as birthright (magic soil) citizenship applies, so in that interpretation a child born of two non-citizens within our borders would have the same citizenship considerations as the child of a foreign diplomat, which is currently a very rare case but those children don't receive birthright citizenship. That would correct almost all the birthright citizenship related problems. Your parents would have to be at least one US citizen or fully legal resident.

Some have made that argument, but it's not very convincing. Diplomats are clearly not subject to the jurisdiction of the United States, as they cannot be prosecuted for crimes (diplomatic immunity), but most other aliens, legal or not, are subject to the jurisdiction of the United States. There hasn't been a lot of litigation on this, but changing that interpretation would be a pretty big U-turn.

I know constitutional amendments are difficult, but I think an appropriately crafted proposed amendment might stand a chance.
