The consumer fraud claims just may be enough to survive a 12(b)6) motion to dismiss. But may not survive a summary judgment filing. Difference being some discovery could occur between the two.

Not holding my breath though.

I know as much about Iowa law as you do, so your guess is as good as mine.

But I don't think this case is about "Getting discovery" as some claim. That cuts both ways. the Trump campaign doesn't want its communications with funding sources, its internal polling and memos etc. to be produced in discovery either.

I think its about fighting fire with fire and making Dems play their own game.

Went back to listen to Baris (had Barnes, blech, with him) right after the poll dropped and Seltzer had that interview with Halperin. There was something else going on with Selzer. My sense is not tied directly to Kamala's campaign, nor DNC but with a left NGO.

So we will see how far this goes.
