The conviction was overturned because they apparently had made a deal early on not to prosecute him (Kim Foxx's work) and then did it anyway. The decision does not mean that he's not guilty of making up the story.

Gotta love good old legal loopholes.

This is not that surprising to me. But one corrupt agenda driven prosecutor can derail criminal cases which is what Kim Foxx did early in the case. Struck a deal. Now the Illinois state supreme court has said that deal precluded the subsequent prosecution.

Just like we saw this week with a Soros DA taking the death penalty off of the table in the Laken Riley case very early on.

Yeah, he should be in jail, but the bottom line is the gov't acted in bad faith and got called out on it. Bad faith twice...bad faith on the Kim Fox original deal and then prosecuting him after the original signed deal. Gov't can't be allowed to renege on deals.

Yes. Short of Smollett actually bribing Kim Foxx for that deal, they are enforceable unless illegally obtained.

Remember the right to a fair trial belongs to defendants, not the state. So one prosecutor from the state can hamstring any other state prosecutor, as long as they have the jurisdiction and authority to do so.

If this was inverted, there is no way Foxx would have made that deal with a White MAGA supporter had they made a hoax like this..... and there is no way the Dem controlled Illinois Supreme Court would have thrown it out.

This is what a stacked justice system looks like.

Jussie Smollet got away with an actual crime, barely having his hand slapped with a 10K fine. While Alex Jones is at risk of losing essentially everything he owns. How is this just in America?
