Blue state fail.
I guess it's OK to stage a fake racist/homophobic attack and blame it on MAGA.

I'd have to leave that to the lawyer types to say, but apparently the Illinois Supreme Court though so.Muy said:
Was that "deal" legally binding? If not, who cares, the guy broke the law and needs to pay the price.
Some parallels to the Bill Cosby case.japantiger said:
Yeah, he should be in jail, but the bottom line is the gov't acted in bad faith and got called out on it. Bad faith twice...bad faith on the Kim Fox original deal and then prosecuting him after the original signed deal. Gov't can't be allowed to renege on deals.
Yes. Short of Smollett actually bribing Kim Foxx for that deal, they are enforceable unless illegally obtained.Muy said:

Some may actually recall this was brought up as a potential issue way back then. I'm surprised it took this long.CoppellAg93 said:
They were just talking about this on Fox.
The conviction was overturned because they apparently had made a deal early on not to prosecute him (Kim Foxx's work) and then did it anyway. The decision does not mean that he's not guilty of making up the story.
Gotta love good old legal loopholes.

Judge Pat O'Brien, who is a Republican running against Foxx for Cook County State's Attorney in November, issued a statement saying, "This report makes it crystal clear that Kim Foxx engaged in a substantial abuse of discretion by making false statements to the public about this case, breaching the State's Attorney's ethical obligations of honesty and transparency, In light of this report and so many other ethical lapses, Kim Foxx should resign from office."
NO NOT RESIGN. SHOULD BE TERMINATED IF ARREST ISN'T AVAILABLE!jimscott85 said:Some may actually recall this was brought up as a potential issue way back then. I'm surprised it took this long.CoppellAg93 said:

If this was inverted, there is no way Foxx would have made that deal with a White MAGA supporter had they made a hoax like this..... and there is no way the Dem controlled Illinois Supreme Court would have thrown it out.AggieZUUL said:

It's truly corruption and evil
Basically he paid a $10,000 fine and did community service and Cook County dropped the charges. Then he was reindicted on the same charges, which is double jeopardy.Quote:
But after initially charging Smollett with disorderly conduct, Cook County prosecutors dropped the charges against him, noting that he had forfeited his $10,000 bond and had done community service.
After the decision to drop the charges drew significant backlash from the public, former Cook County Judge Michael Toomin appointed former U.S. attorney Dan Webb as a special prosecutor in the case. Webb eventually refiled charges, but Smollett's attorneys have now successfully argued that the new charges amounted to a violation of the double jeopardy clause of the Fifth Amendment, which prevents an individual from being prosecuted twice for the same crime.
"It defies credulity to believe that defendant would agree to forfeit $10,000 with the understanding that CCSAO could simply reindict him the following day," the state supreme court wrote.
Agree. Diversion agreements, such as this need to be enforced, barring any illegality occurring.Quote:

You can debate the merits of whether a $10,000 fine and community service was sufficient, once served he can't be charged again, and that is a good thing.
