3 U.S. Code, Chapter 1, 7 - Meeting and vote of electors
"The electors of President and Vice President of each State shall meet and give their votes on the first Tuesday after the second Wednesday in December next following their appointment at such place in each State in accordance with the laws of the State enacted prior to election day."
Then the 12th Amendment kicks in.
"The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;- […]."
This can't happen until the Senate and House report for duty on January 3 in accordance with Section 1 of the 20th Amendment.
The votes will be counted January 6, 2025. The President of the Senate (Kamala Harris), the Archivist of the United States, and other designated Federal and State officials must have the electoral votes in hand at this time.
This occurs two weeks before the inauguration, which take place in accordance with Section 1 of the 20th Amendment. .
