I can't think of a stupider thing to do politically than not to recharge him…letting a criminal get away with his crimes just because he's running for president would set an incredibly dangerous precedent.

If you actually cared about law and order, you would want Trump in prison where where he belongs. No one is above the law.

The case would most likely never see a court room until sometime in 2025, but you'd be handing your opponent another political tailwind like you did when you first announced these charges.

This case was never about rule of law to begin with. It was about intimidating Trump and Republican voters.

This case was for sure. This judge, however, is a GOP friendly judge. DOJ was going to have to be perfect to get this past her, and obviously she took issue with how Smith was appointed to start with all of this.
The law is clear. It is a shame it took this long to get the case thrown out. It's also a shame that a lot will have to be done to overturn Merchan's case.

Sad that the left is so unethical that they resort to criminal actions against the president because they hate him. Add trying to kill him to the mix.

He was never appointed as a prosecutor via congressional approval, I think that's the distinction

no. It's just that the method of appointment, how they're funded, etc. is more nuanced than saying, "hey lawyer guy, here's a job to do and an unlimited budget. Be sure to tell people how closely we supervise you (or don't) based on whatever suits your case."

To help you out, she basically dismissed the case because Jack Smith's appointment was unconstitutional/unlawful..

We could easily say Jack Smith is Democrat Friendly, which he is, but it would be pointless like your comment.

Well there is a concept of parallel construction that can eliminate fruit of the poisonous tree.

But if Garland really wants to go down that route and appoint a Senate confirmed SC, they would likely streamline the case back down to just the obstruction charges and leave the classified stuff out.

OTOH, Smith could appeal to the 11th Circuit first, however long that takes.
