Oh, and 42.01(10) carries a maximum penalty of a 500 fine. Seems kinda a low penalty for a guy exposing himself to a kid, if it would even apply.

The point, again, is that we all watched the video and assume that could never happen here because we have laws to stop this in our great state of Texas. But, none of you looked at our statutes. They are worded similarly. The enforcement of those statutes is what will matter. There are 254 counties in Texas, how that staute is enforced where you live will be what matters. Unless there is a change to the law. Personally, I dont think the law should rely on someone's arousal or gratification. I think once you expose yourself to someone else that should do it.

Statutes is only part of the equation. Here in Texas, we still have a somewhat unique ideology on life. We often joke about "**** around, find out". I've been in and lived numerous places, Texas is the closest to a living, breathing embodiment of that.

Lawful, or not, if someone were to expose themselves to my 5yo son, I wouldn't think "Is he abiding by statutes?". That switch would flip, and I'd do everything within my power to end his life with my bare hands and any concrete nearby. My childhood was marred by sexual things and I'll be damned if I'm going to let some depraved ****stick marring my son's.

This is the reason we have the disorderly conduct statute cited earlier. I had some friends get one for pissing on a building on the way back from the Chicken. Each got a ticket.

(b)An act of oral or anal sexual intercourse;

Texas indecent exposure law:

They are written similarly. I think instead of trying to defend this statute it should be changed to eleminate this extra element of the crime.

If someone approaches my child in my yard, completely naked or even half naked, I do not care about the legaltiy of it. I don't care if it is drugs, perversion, or they belong in a psych ward. Let's for the sake of argument, a fully naked man is dancing on the sidewalk, just a few feet away from your child.
