NSIAP - Viva Frei's reaction. Nice summary of how we got here and where things stand if you haven't been following day-to-day.

Trump should go to MAL and skip the rest of the trial, make them arrest him in Florida. Maximize the show.

I'm expecting that as well. His prior actions make it clear that he is willing to go there. Why would he give Trump probation when his directive is to damage Trump as much as possible?

Biden's DOJ would send in his super duper FBI with tactigear chambered and ready to take him out while Trump's playing golf.

I think there is a strong sentiment among democrats that that might just be a bridge too far for the American people and some really awful things could happen. The aesthetic of Trump sitting in Rikers is MUCH different than a conviction on charges most Americans don't even understand.

Sure the far left wing of the party wants him in jail, but the run of the mill democrats who drive the party know there is a line somewhere they shouldn't cross. I suspect that it is.

Me, too. There's nothing for him to lose. He's a hero to the fascists.

Nothing has been too far so far. Spying on him? Nope. The first impeachment? Nope. The second impeachment? Nope. Planting documents and raiding his house? Nope. Charging him with conspiracy for saying he didn't believe the election was fair? Nope. Prosecuting him for things that weren't illegal, that the statute of limitations had run on? Nope. It will never be too far.

I am just ready for the right to do the same back.

Quote:

One potential juror was excused after he said he has concerns about his unconscious bias. He noted he is from Texas and has lots of friends who are Republican.
Judge Juan Merchan asked if he thinks he could be impartial, and the man replied: "It's probably going to be tough for me to be impartial."
"We appreciate your candor," Merchan said as he excuses the juror.

This is why we lose

while I had naively thought there might be one hold out to get a hung jury, deep down this was the expected verdict for most watching.

Even though it's not a surprise the verdict was guilty, it's not any less disheartening. Sad day for America.

Jury instructions catered to the prosecution, case built on the GLOAT MVP of lying, defense hamstrung on how it defended the case, and charges that never would have even been presented to a grand jury if it were anyone else. Start to finish, one big setup.

Sadly, I don't believe this has any big effect on the election. It will give Trump a bump in fundraising, but I think the lines are already drawn on voters that this case mattered to.

Sad day. Going to tune out the news for awhile, too depressing

Republicans have got to get involved with their local elections as poll watchers, precinct chairs, judges, whatever. Be present as much as possible during early voting and on Election Day. Dont let any 2 AM shenanigans occur this year!

Todd Blanche should appeal directly to SCOTUS, using Bush v. Gore and every other presidential election case as grounds for expedited review.

Are there really six justices who would vote to not hear this case given what's at stake is just as relevant in 2024 as it was in 2000?

I've read some claims this can/should be done (direct to SCOTUS) but remember this is really just a private citizen trial in a state court. That his rights were violated is patently clear, but there's no real issue for the SCOTUS to step in immediately to handle. Now, if they try to send him to Rikers in July, that might be another matter.

This is NOT in any way "just a private citizen". How do people come up with this?

Could Trump succeed if he argues irreparable damage if the appeal isn't resolved by the election so that SCOTUS is the best venue?

If he won his appeal but the appeal was resolved after the election he could still face harm caused by the verdict

It's a question for the state appellate court to weigh. There's really no SCOTUS question, imho. And legally again, he is just a private citizen (right now).

I'm not handwaving away how outrageous all this is at all, just practically talking about some sort of direct appeal to SCOTUS. That's just not gonna happen/work, folks.

The fire is only beginning to burn and will get much worse. At the scheduled sentencing date on 7/11, the judge will probably sentence Donald Trump to some jail time. Still, I will vote for Donald Trump in the general election.

Probably zero! Those thinking Trump has an easy win on appeal are in for a long road.

Agree with the appeal to SCOTUS if there is a path for it. The Dems are attempting to disenfranchise millions of Americans by prosecuting and potentially jailing their nominee with a stacked deck hand picked biased judge who did not care about reversible errors and was compromised and should have recused, a jury that was picked from a district that votes 90%+ Dem, an AG who got his job based on getting Trump, and a prosecutor from Biden's own DOJ who magically left a higher federal position to go help with a state case.

Yeah, I didn't have much faith before on the NY appellate court system...now I have even less.

And for those in this thread who said there is no way the judge will send Trump to prison at all because it's a white collar crime and Trump has no previous convictions, have you been paying attention at all the past year? From the grand jury through this trial, Merchan has been on a crusade to get Trump. There is no way Merchan is not sentencing him to jail time.

Sentencing Trump to jail time is not synonymous with Trump actually being incarcerated.

A country in distress.

This kind of thing does those who actually served in wars and had a REAL need to fly it a great disservice. Those folks often died.

Some number of soldiers dying in wars, as tragic as that is, doesn't hold a candle to what is happening in this country right now.

You're whistling past the graveyard like the poet who said "but I was not a jew" so they didn't care. Marxist authoritarians are taking over this country and persecuting their political opponents.

It doesn't work out well for anyone other than the political elites.

There are 20 justices at the appellate court. The chances that he would draw this exact panel are rather slim.

Don't underestimate the NY court system.

The chances of Merchan getting all of the Trump-related trials he did was even more slim...way more slim.

I am not sure we, as a country, can come back from this. The appellate division in Manhattan will not provide an expedited appeal. And given the makeup of that court, no meaningful review will be done. NY Court of Appeals might provide some relief as the recent reversal of the Harvey Weinstein verdict.

Can the US Supreme Court step in? Before the state appellate procedure has been completed? People point to Bush v. Gore in 2000 but A) that decision itself was stated to have no precedential value and B) the Court took the case from the Florida state supreme court, not a trial court. And the Court's reputation has taken a massive hit since then.

Nor is this a death penalty case, another area in which SCOTUS can and has issued stays to a trial court pending a constitutional review.

But let us suppose enough Justices are deeply concerned enough to grant such an extraordinary writ and stay further proceedings in the trial court? What would be the blowback? How severe? And how far would it extend?

We saw in 2020 how our elections can be manipulated towards a certain preferred outcome. Putting the composition of the Court on the ballot as an issue with promises to either impeach Justices or change the Judiciary Act to pack the Court with activist Justices? Just need control of both Houses of Congress and the WH to destroy the US Supreme Court.

After that, is there any coming back?

No we are lost until Jesus returns and goes scorched earth. Point of no return was somewhere right after the 2020 election.
