As a person very familiar with the criminal justice system in Texas I have never ever seen:
A federal crime prosecuted in state court;
A case where where the jury is not required to find all elements OF EACH COUNT beyond a reasonable doubt. They were erroneously allowed here to find 3 elements from one, 3 from another and 3 from a third count;
A a case where no limit is put on extraneous bad conduct proof when most of it is not relevant to proof of the elements of the actual crimes charged. Just dirty the defendant in ways totally unrelated to the actual charge;
A case where the actual crime charged is not specified in the indictment.
A case where there is a gag order against the defendant;
A case where the jury is not allowed to take the judge's instructions to the jury with them into the jury room;
There are more. I just can't recall them now. This judge has broken every rule in the criminal law and evidence book.
