Merchan is telling counsel he will not formulate jury instructions on any of the three theories of the "other crimes" underlying the elevation of the charges to felonies. This trial is just meant to change the outcome of the 2024 election. If it fails on appeal, I don't think they really care.

Both. It was always ambitious to believe they could get to closing summations by Tuesday morning. Just too much left to do before handing the case over to the jury for deliberations.
