He admitted to having sex with her though and I believe the age of consent in California is 18.
They had her on video lying about her age. She was telling people she was 18.

Is that a defense to criminal prosecution though? I don't believe it is in Texas, but hopefully a criminal law attorney can post.
It was enough of a defense for the DA not to seek charges. She presented herself as someone that was 18. Her fraudulent representation of her age is absolutely a factor

From the article:

Quote:

The Bills said they also knew about the incident, investigated it and decided to employ Araiza anyway.
The graphic allegations in the civil lawsuit, however, created a public frenzy. It included a claim that during an Oct. 15, 2021, party at a home near the SDSU campus, Araiza led the girl into a bedroom where "at least three other men" waited.
"Once inside, Araiza threw [the girl] onto the bed face first," the lawsuit read. "[The girl] went in and in and out of consciousness while" suffering through "the horrific gang rape." It lasted an hour and a half, the lawsuit read, before she "stumbled out of the room bloody and crying" in part because "multiple piercings had ripped through the skin during the attack."
Within days the Bills cut Araiza, who due to his record breaking NCAA career and an 82-yard punt in a preseason game, had earned the nickname "Punt God." "We just think it's the best move for everyone to move on from Matt and let him take care of this situation," Buffalo general manager Brandon Beane said.
The Bills are also responsible here. They knew about the allegations and caved to the crowd. If they had any integrity and bravery they would have called it like it is - an allegation that the player denies. Screw Brandon Beane.

The story had been around for a while before the Bills cut him. They caved to public outcry even though they believed his story about the incident. Mob justice wins again. But if the dude was a QB, then he would have kept getting paid while on leave like Deshaun Watson was for the massage mess

That's a risk. You know it going in.

Yeah, with statutory rape the idea is the minor is too young to consent, and the burden is on the adult to make sure they're not sleeping with a minor.

Usually the "I thought she was old enough" defense wouldn't fly, but I guess the circumstances of this one let him escape prosecution. He still slept with a minor at a party, and it turned into national news.

I don't see the Bills having to pay for it apart from a wasted draft pick.

Don't think there was much sleeping involved. Sounds like they had a quickie outside before she went back inside to brag to her friends about it.
Went into the backyard and saw him taking a piss. Romantic encounter ensues-- just like the movies.

I am not understanding how the Bills and the accuser won't be on the hook here.

Bills can do whatever they want, but seems logical that they are not allowed to fire someone on a false rumor.

With that logic, wouldn't you have to prove that the Bills KNEW the allegations were false and fired him anyway?
But the Bills admitted they knew about the accusations prior to the draft. So obviously they thought it was a nothing burger at some point

Devil's advocate: how often do we hear about teams "doing the research" beforehand, only to find out they did practically nothing?
Even if he's a punter - if there was an allegation about rape, they were going to do some research. They must have felt the true story would come out or would die out in their favor. They get embarrassed now that they let him go.

Fair enough. But the risks are substantially different. Let just say I was way more picky about the girl I married than I girl I may happen to hook up with in the backyard of a party. Hypothetically of course.

Well, they were different back when I went to college.

What if we assumed people were innocent until proven guilty? Would that work?

There are people that believe some crimes/acts/accusations are so serious, even being innocent of them is no defense.

Not a fan of that either. It provides a massive disincentive to report rape/SA to the police.

We should just do the whole innocent until proven guilty thing. I know that's extremely unpopular nowadays

Except that an innocent dude faced serious repercussions for something he didn't do. That woman absolutely needs to spend some time in prison. She should also have to pay his lost salary.

She's a victim too if she indeed was raped, but it doesn't make it OK to falsely accuse someone else and ruin their life. There has to be some kind of consequences.

There has to be consequences for knowingly making a false claim. Otherwise, there's no reason not to take the shot, which is exactly what she did. Even if innocent until proven guilty, the mere accusation is enough to permanently taint a reputation and there is a cost in time, money, and emotional distress involved in fighting such an accusation.

Article makes it sound like it might have even been mutual group sex rather than rape. Sounds like she had specific intentions. Why in the world you would turn that into rape accusations is crazy (if the article is to be believed).

Still - I believe there is some advice about sticking your pee pee in loco????

Get out of here with your logic.

Plus Republicans and conservatives aren't allowed to be innocent, Ever.

However, if you are a liberal or a Democrat, you're never guilty.
