Quote:

A Las Vegas HOA is fighting with a family over the incredible backyard treehouse they built for their autistic daughter, simply because it doesn't fit their stringent rules.

Phil Edgar, who works in tech sales, lives in a gated community in Las Vegas with his wife Lily, 14-year-old son Colin and 12-year-old daughter Claire, who has autism.

When the couple started renovating their home recently, Lily, who has a passion for design, was eager to create an outdoor space for Claire to play in.

Quote:

But the Las Vegas Country Club Master Association has since told the family it had to go.

They say that because the treehouse is around 25ft off the ground, it does not meet their 6ft maximum height requirement.

Now, Phil is appealing to the board to see the value in the treehouse - after failing to appeal to their humanity.

'I would really like to solve this amicably. I am trying to get clarity on exactly which rules we're breaking.

'They say it needs to be invisible from the outside and it mostly is. We back onto a golf course and they don't mind it they are fine with it.

It's a nice treehouse and not an eyesore. It's better than all the tents and piles of **** on the streets of major blue cities.

If your 12 yr old wants to chop off his dick or tits, that's perfectly ok, but autistic daughter can't have her treehouse.

I f'ing hate HOAs and so glad I don't have to deal with one anymore.

That's sad. It's a dope tree house. I can get it if it were an eyesore, but it doesnt look it. I can probably walk around my suburban neighborhood and point to several neighbors with overgrown weeds that i'd complain about, but a treehouse like THAT?

The family should list it as an AIRBNB and then sue the HOA for being racist for shutting them down. Fight fire with fire. #StopAsianHate #StopAutismHate

Looks to me like they spent an incredible amount of money and resources without doing their homework on what is or is not allowed by the HOA. These are deed restrictions and covenants that were provided to them prior to closing on their home.

Your disdain for HOA's has no bearing on the left, or trans/gender affirmation and body modification.

We don't get to pick the rules we choose to obey and the ones that we choose to ignore. If you want to draw a comparison to leftist DA's that do just that, then you are no different from them. The right thing to do is to live by the rules.

The left has taught us that "rules" don't apply to POCs or those with disabilities when they are treated poorly. Just shed a few tears thereby shutting up the Karens that whined about the treehouse, and move on.

My HOA fought a HUD lawsuit to prevent me from having a homemade stained cedar and black rope tree swing in my front yard.

So no. I don't have any respect for anyone on an HOA. The amount of hubris it takes to tell another man what he can do with his own home is disgusting.

Don't buy in an HOA if you want to build a giant separate structure from the house, lol, and who knows if it's got a utility hookup or not. If you want to build it on your own terms, don't sign a contract that says you promise to submit your plans for the HOA's approval.

Also, wouldn't be surprised if this family is being dishonest and wants to use this "treehouse" as an Airbnb or guest house and generate income off it, which may also violate the covenants, or the promise not to subdivide the property.

These emotional appeals about the autistic daughter are completely irrelevant. The way it looks is also irrelevant. These people probably told the HOA to go pound sand and now are mad the HOA is calling their bluff.

I agree at its core it's stupid, but if the HOA ignores the rules for these people what's to stop everyone else in the neighborhood from building treehouses and guest homes and pointing to this as justification to tell the HOA to piss off?

To be CRYSTAL clear that would be the HOA that you were informed of before you chose to buy the property. The HOA with the deed restrictions and the covenants that you were provided copies of prior to closing and likely within the option period. If this was a new build you were provided these before you even signed on the lot. So you were provided the rules, agreed to the rules, and are pissed because the rules apply to you.

HOAs are communist organizations and I am grateful to live on a small piece of property out in the country.

We lived in Reston, VA close to 5 years before moving back home in 2019. Any change to the exterior of the house required getting a signature from three neighbors and presenting plans to the board. And by change I mean anything. I wanted to replace the old grass front porch lights with bronze. That required board approval, as did painting the front door a different color.

When we wanted to build a fence in the backyard for the dogs one of our neighbors refused to sign the form, so I put in an invisible electric fence. The same dumbass neighbor a few months later asked me (and this is not a joke) to instruct the dogs to dedicate on the other side of the yard. Can't make this up.
You can't fix stupid.

I definitely agree 1000%, but try living someplace without an HOA. You get to keep money in your pocket each year, but your neighbors will basically treat neighborly decorum like the piss-ditch at Burning Man without any legal teeth to correct them.

I was a young 24 year old, first time homeowner who bought a 10 year old house and had to go toe to toe with my retired 65+ ******* of a neighbor to replace a section of his fence on my west side. The north and east side neighbors had no problems and we split the cost equally with nothing more than a knock on their door and a quick handshake agreement, but the west neighbor said he "did not believe in paying to fix fences". So it was either I pay for it all myself or have to deal with a fence that was falling apart.

People will pick any *********reason to be petty *******s.

It sucks.

Yup. And they're backed by Associa and the full force of the law which was literally drafted by the guy who founded Associa in order to make himself a billionaire with the Texas government as his enforcement arm.

Pure evil, how any "conservative" can supper HOAs is baffling.

"But the Dallas millionaire isn't just the president and CEO of Associa. He's also a powerful state senator who chairs the Committee on Business and Commerce and who, back in 2001, authored the law that enshrined pro-industry HOA foreclosure practices in statute, ensuring that associations like Brookfield's could continue to aggressively collect fees and dues from homeowners. And if you're flabbergasted by that fact, well, you don't know much about Texas politics."

What are you talking about? I am on the board and we are fixing the rules. They are multiple ways boards can abuse rules even under the new laws.

HOAs are dumb. They protect builders who want tax breaks and they allow napoleons to be idiots. But they allow cities to put costs in builders and buyers and waste tax money on other things.

Our HOA changes the design standards all the damn time. When I argued that at a board meeting I was told that the board and the ACC have the right to amend design modifications whenever they feel like it. and if I disagreed I could gladly sue them.

HUD disagreed that their rules violated the FHA specifically in regards to disparite impact on the restriction of recreational equipment in the front yards; e.g. lawn furniture of wood or metal being allowed in the front yards but a tree swing not being allowed.

HUD said that if I wanted to fight them on their ability to l change covenants without going to a vote I'd have to sue them in local court. In Texas the laws were specifically created so that there is no oversight board for out of control HOA members.

So if they break their own rules your only recourse is to front your own money in court against them and their army of attorneys from Associa. Better not lose because you'll be out a fortune.

There was no community vote on that. It was decided and ruled upon in private session by the board and the ACC.

And yes I was very involved up front following the rules with requests, petitions submitting design requests etc.
