LOL. Schroeder managed to confuse himself reading the jury instructions during the Rittenhouse trial too.

That's another thing about Wisconsin and Schroeder's court. They use a tumbler to select the alternates and those remaining 12 are the jury. And it is the defendant who draws the numbers.

BTW: Judge has moved up court to begin at 8:30 AM to begin closing arguments. He did not place any time limits but cautioned that the brain's ability to absorb and understand is tempered by the butt's ability to endure sitting.

Gravely loves to hear himself speak so expect him to be longwinded. From a defense standpoint, the lack of evidence here makes it hard to say there is no evidence over and over again. So I expect their closing will be pretty brief by comparison. 45 minutes, maybe an hour max.

Judge has another matter to attend to so he will be gone from 12 until 2. So getting the case to the jury before he has to leave would be best.

No. Didn't see any voir dire. No clue. And the usual court watchers for CourtTV or Law and Crime and tweeting ou from the courtroom didn't seem to be at this trial for some reason. Jamesfromcourt also took some time off after Murdaugh.

I have a really difficult time with this line of argument from a prosecutor. "Well the reason we don't have evidence that he did it is because he's a great planner. We don't know what weapon he used and we don't know where the body is because he's just good at killing people."

That's basically what he's saying. They can pull anybody off the street to charge and make this same exact argument.

And Gravely just said the "body" was found on May 19th. That is a blatant lie. Not a misstatement, a lie. These are prepared remarks. If he had misspoke, he would have corrected himself.

I had to rewind when he said that because I thought I heard wrong.

Again, if Zach was all that great at stalking Gutierrez, he woul have known Gutierrez was cheating on her with multiple other women. She was the only one he had successfully gotten into bed but not for lack of trying.

Gravely came very close to burden shifting. In fact most of his argument is vaguely burden shifting with all of the "most unlucky guy."

So taking screen shots off a public FaceBook site is stalking? During a custody battle?

Gravely finally stops. Judge takes a break before the defense begins. Then state gets rebuttal.

A lot of the so-called "evidence" he cited was thin and speculative. And then a few outright lies such as finding the body, (they didn't nor did they even find human remains in the defendant's firepit nor anywhere else.)

Just like Binger, stretching the time line well past the three minutes in the Rittenhouse trial for example. Apple didn't fall far from Gravely's tree.

Defense counsel, one of the males, is giving the closing. Kind of surprised it wasn't Nicole.

That speck in the back of defendant's van was not large enough to test for both blood and DNA. They chose to do DNA. Single source male but could not confirm who it belonged to. And by definition nor could they confirm it was even blood.

Familial DNA is helpful but not dispositive for inclusion or exclusion to any statistically high certainty.

Jusge just scolded the DA about their closing statements needed to be over by noon since his wife is ill and he needs to be with her for an appointment.

Female DA says she will be brief and finsh before then. Riiight.

I think they come back late today. Around four or five.

Jury already had first questions. Another judge had to step in with counsel's participation. The questions pertained to when photos and files were opened on Zach's computer.

Pertains to the stalking charges. IIRC, those were the first two counts? So taking them in order or not?

We are back in the courtroom. Expecting a break for the evening since the defendant is not present.

ETA: Judge calls jury tells them 5:30 is the cut off and they would have to come back tomorrow. Foreperson asks for a few minutes to talk it over. Waiting for the jury to decide time to go home?

Jury is quitting for the day. Judge will call them into the courtroom and tell them not to discuss the case, even among themselves until they are all back together tomorrow.

Saw on another site the jury is 7 women and 5 men.

I think the 7 women have him guilty.

Not so sure about that. Women judge other women a bit more harshly. Sadie was not a great witness on the stand and the daughter was a disaster. Also Gutierrez is not a really sympathetic guy either. Multiple baby mamas, using Facebok dating app for random hookups.
