My understanding was that this wasn't illegal back then. Is this a civil lawsuit? Does ex post facto apply to civil?
exploitation, sexual harassment, fraud, sexual abuse, negligence, and the distribution of nude images of children
This is not in support or to condone these pictures / scenes, but there used to be an exclusion for underage nudity images that were not sexually explicit.
Brooke Shields had at least one movie if not more where she was underage naked. And in her examples it seems impossible to argue the nature of the nudity was not in the context of being sexually explicit even if the scene was not.
I have no idea where the rules / law stand now on this. My hope was that its been tightened up considerably.
But to sue after 55 years is ridiculous. But Cali gonna Cali.
