This is not in support or to condone these pictures / scenes, but there used to be an exclusion for underage nudity images that were not sexually explicit.

Brooke Shields had at least one movie if not more where she was underage naked. And in her examples it seems impossible to argue the nature of the nudity was not in the context of being sexually explicit even if the scene was not.

I have no idea where the rules / law stand now on this. My hope was that its been tightened up considerably.

But to sue after 55 years is ridiculous. But Cali gonna Cali.

you are talking about child pornography as a crime. that does not apply to the claims made here. even if something is not a crime, there can be civil liability

i do agree suing now is ridiculous.

The federal law against child sexual exploitation wasn't passed until 1977. Echoing what ftc said, I'm pretty sure there were exceptions that were allowed even after that. It wasn't until the PROTECT act in 2003 that the gov really cracked down on their "no minor nudity in movies" stance. How Man of Steel got around that with a naked baby in 2013 I'm not sure.

This movie is from 1968 and I'm also pretty sure it was filmed in the UK. Age of consent there is (or was, I didn't check) 16, which both actresses were.

Well, you asked when they weren't illegal.

Which is why I asked about ex post facto for civil. Can you really claim damages when 1.) it wasn't illegal, 2.) you agreed and signed a contract 3.) you received monetary compensation? They're clearly trying to cash in on the sentiment of current law.

if you are sexually harrassed, or abused, or there is fraud, then yes. (that is the claim they are making)

I was referring to the distribution part. That was clearly legal in some circumstances. It's the reason you can still buy those movies today.
