Wither way, this was a very bizarre and extreme situation. No one is cool with that. But if you cannot see how confusing this was for the cops, I just can't help you. They rolled up on a dude frantically shooting into a home. They didn't know it was his home. Sometimes, things are just unfortunate, but there is no real malice or wrong doing.

Protecting his property from what? It "appears" that he was indiscriminately firing rounds back toward his home. A police cruiser is seen passing by at the time of the discharge. As several have already stated, there are number of unfortunate factors, by both parties, that contributed to his fatal shooting. Let the investigation run it's course.

And when the cops show up they're supposed to be downloaded with a 100% accurate, real time, assessment of the situation and give every deference to the dude firing an AR in to a home and be willing to sacrifice their lives for said individual by taking whatever great risks random message board posters find fit. I have a wife and two kids at home. If cops show up and find me discharging an AR in to my home I am ok with them smoking me considering it is highly likely my wife and children are in said home. 99% of the time they would be right in assuming I had lost my mind and protecting the innocent (and themselves) was priority one.

He is staggering around outside mumbling to himself and firing into his house over an extended enough period of time that both the callers and arriving police witnessed him discharging the gun.

I was a cop for 16 years, that is not a normal homeowner response.

Oh and the fact that there is NO ONE actually inside his house.

Texas Penal Code Section 790.15 prohibits discharging a firearm in public or on residential property under certain circumstances.

We have laws against firing weapons indiscriminately for many obvious reasons. This guy was going to injure someone if the police did not intervene.

Even if there was someone in the home, firing indiscriminately into the house with no target doesn't seem like it would fly. Even with Texas' very permissible property defense laws.

I would also think the police have a duty to protect an intruder once they show up as well. Combine that with the fact that the police don't know if there's any innocent parties in the home, and the guy was clearly firing randomly, yeah, I don't think this is making it past the GJ.
