I support the police but this is insane. This happened in South Austin.

It's up to a grand jury to decide whether or not to indict him if the DA presents a case to them.

I have presented hundreds of cases to a grand jury as a prosecutor and they indicted every single one that I told them to and no billed all but one that I told them to no bill.

The old axiom holds true that a prosecutor can get a grand jury to indict a ham sandwich.

"Should have just racked one from the clip to scare him. And if that didn't work, just shoot the gun out of his hands"

I guess you're cool with cops killing people protecting their property
There's a difference between defending your property from within the walls of your home and attacking from the outside of your home. It does not appear he was trying to save anyone inside so why fire like that? The law would not be in his favor.

Best not to chaotically reveal you are armed with confusion all in the air. Is your right, just not best use of right.

What tells you that his belief wasn't reasonable?

He is staggering around outside mumbling to himself and firing into his house over an extended enough period of time that both the callers and arriving police witnessed him discharging the gun.

I was a cop for 16 years, that is not a normal homeowner response.

Oh and the fact that there is NO ONE actually inside his house.
I am 100% 2nd amendment. The right to own a gun shall not be infringed.

But, owning a gun is a dangerous thing. It requires a certain amount of responsibility. Irresponsibility is dangerous to your neighbors, and might result in your own death.

Mumbling weird stuff and shooting holes into your own house in a suburban neighborhood is not exhibiting the required amount of responsibility for owning a gun safely.

I would rather have the cop that burned this guy down living on my block than the myriad of cops that screwed up Uvalde.

If you question whether the Travis County DA will indict this officer, then you haven't been keeping up with the happenings in Travis County.
