Yeah, this guy's an idiot, but even the church whose flag he burned didn't want him to go to prison, so the prosecutors should have taken that into consideration instead of asking for the maximum sentence (even if the prosecutors wouldn't offer him probation, they still could have asked for a lesser sentence than the maximum). Also, this guy had two prior felony convictions, one drug related and one theft related, so that's not a bunch of priors.
I'm all for redemption and certainly no saint but if you have two felonies and are dumb enough to commit any other crime outside of traffic violations. Come on man.

What constitutes felony theft? Is it not felony theft to steal an American flag from my front porch? Isn't there a specific dollar amount attached to felony theft?
All depends I believe. And I'm sure some small forms still constitute as a felony but my point remains.
