Do the facts on the PCA get treated as concrete in the trial?

Is that why there is a bare minimum of "this is what we're disclosing so far."
Hell no they don't. At best, that is mostly hearsay. So at trial the prosecution puts witnesses on the stand to back those allegations up.

This may be improbable, but an interesting experiment as well as COMPLETE speculation:

Bethany Funke or Dylan Mortenson were involved with BK romantically or otherwise.

The reason he had been there so frequently wasn't stalking, it was visits to hook up with this girl he met on a dating app.

Dylan and Bethany may have known this guy.

If BK is innocent, it would be easy to frame him knowing he is coming over for a visit.

We don't know what time he left the house. All we know is what Dylan has said.

Perhaps one of the girls said she felt unsafe in the house. He gives her his knife to protect her.

All of this will be much easier to speculate on AFTER proceedings begin and we have more information, but as of now there are some things off with the stories.

Occam thinks you need to shave.
If he's being framed, why did he just happen to turn his phone off on the way to the house and leave it off for the time surrounding the murders?

Phone died on the drive over. He left it on the charger in his car to recharge and it came to life on his way back home.

I have nothin against ya bud, but when you have to have all these things happen just perfectly for a theory to work that doesn't have a shred of common sense backing in the first place, I think you may working backwards from a theory to tie it to facts rather than the other way around.

I understand, but the only data we really have is from an affidavit for arrest.

Those don't present ALL information. It only says why we should arrest this guy and figure it out.

So of course it looks like this is the guy. The investigators have run a tight ship with no leaks. So of course we have no info other than "This is the guy!"

The declaration of probable cause is not "we should arrest this guy and figure it out later." It's "we've very likely figured it out. We believe it's this guy, and here is why."

Understood. The point is that what has been revealed is in no way the entire picture. And the evidence presented in the affidavit is only that which implicates BK. So without contrary we should be hesitant to be all on board with this.

In NO way am I saying he isn't the killer.

If true, The girl who saw him but didn't call the police because she was tripping, I would hate to carry that burden with me the rest of my life.

Obvious he is our guy with his phone and car pings, hope additional evidence is leaked out purposely.

Food delivery at 4am?

What?

It is truly amazing how many apparent Aggies on this board seemingly never went to college. "Food delivery at 4 a.m.? What?" "How many restaurants are open 24 hours though?"

It's a ****ing college town. College. CO-LLEGE. Of course there's kids up and eating food at 4 a.m. Of course there's restaurants open 24 hours. I can't even count the number of times my roommates and I ended up at Whataburger in the middle of night after partying or ordering Gumby's at 3 a.m. If they had door dash back in 2008, we for sure would have done that too.
I majored in engineering, you know the buildings where the bathroom stalls have half written math problems.

Don't remember ever making a 4am food run as I was hanging on by a thread or at least that is how I felt.

I was at A&M in the 2.0 and Go days. I was definitely up at 4am. Was on the College of Engineering's scholastic probation list for 6 consecutive semesters. Only got off scho-pro when they handed me my diploma.
You engineering guys/gals don't happen to build bridges or anything do you?

Once while in between jobs, I took a job with the state designing mix masters in the metroplex. Pay was awful but expectations were low which was good as I was going thru a divorce and just got out of rehab. . I remember even my boss couldn't explain moment forces in indeterminate beams.

What other aspect of #1 would be more graphic than getting murdered? Since most of the initial info that immediately came out after the incident turned out to be true, I'm curious about the rest of the story that you are alluding to since it is likely true too.

Police haven't released what the two surviving roommates were doing the night of the murders, but confirmed that the two girls got home shortly after 1am. The thing with mushrooms is that it makes it hard to sleep. I doubt the girls got home after 1am, and took shrooms once they got home. They would've been up all night if that were the case, also the main shrooms effects usually last 4-6 hours.

They didn't make 911 call until 11:58am. That's almost 11 hours after they got home. The shrooms would have worn off way before then so not sure that theory makes sense, that they were afraid of making the call cause they were tripping. I think it's false.

On the longest route you could possibly take from Moscow to Pullman. There is no way this dude is being framed. Unless you are related to him, I don't see how you could possibly believe he is being framed.

You know who goes the wrong way out of town? People with a dead phone who have relied on GPS their whole life to get them where they are going. It's not like this guy had Key maps like we all used to carry back in the day to tell him where to go.
You know who doesn't go the wrong way out of town? A dude who can be placed in the area a dozen times in the past. Particularly, if he's there for a hookup as you hypothesize. That's a more powerful homing signal than the Monarch migration.

It might also mean she didn't trust her observation of him on the slightest and needed time to decide what about the experience was real or correct.

I don't have experience with psychedelics but from listening to friends describe their experiences it would make sense to me.

Yes, paranoia on them can be very real. Depending upon the drug and dose the trip can be 12 hours, plus.

She will end up on the stand, and I am sure her action/inaction will be fully addressed.

If the witness was tripping on psychedelics maybe she thought anything she heard or saw were hallucinations?

If the witness was in an altered mental state why should we expect her behavior to be completely rational?

This might also be a point the defense team can use to paint this witness as unreliable. How reliable can a witness be when high on psychedelics?

Has it been confirmed by law enforcement that the witness was high at the time? Or that she even witnessed anything?

For being a PHD student in criminology and having masters in crime, this guy wasn't very bright considering he planned these murders for at least days. If he had found a way to drive a car to the crime scene that couldn't be easily linked to him and used a burner phone whenever he went to Pullman (leaving his phone at home), he likely never would have been caught.

Based on the PCA, which is what we have, she cannot positively ID him anyway. It helps with the timeline, at a minimum.

If it comes out she was really shrooming, then I think anything attached to her as a witness is easily thrown out. That would make any eye witness testimony as unreliable as it comes

Even if they have sketchy ID from a witness, that combined with the white car certainly was enough to establish probable cause to investigate him and pass the smell test. Any other evidence against him will not be tainted, presumably enough evidence to convict him.

And even if she wasn't stoned, bushy eyebrows are not enough to convict somebody.

Probably referring to the Reddit post that involved the ceiling fan and a particular knife wound. It was extremely graphic.

In the trial, how does the eyewitness testimony work if the girl really was on psychedelics (or, more likely, just extremely intoxicated)? The defense would obviously want her to go on the record with that info to discredit whatever she says, but she can't be forced to admit that because technically that would be incriminating herself, right? So how does the defense introduce that evidence to the jury? Hope she included it in her statement to the police?

No, the one involving the ceiling fan is not what I'm talking about, and I'm pretty sure that one is false. That was not in any of the early rumors.

If she was high on psychedelics, she's useless as a witness. How can she reliably gauge what time things happened, what she saw and heard vs what were hallucinations? The guy had a mask, well pretty sure people tripping see scary faces in plants too, and lose track of time. IF she was high on drugs that induce hallucinations then her accounting of events isn't reliable.

Like stated above, the witness being high is a big speculation not confirmed by investigators yet.

This whole thread is taking bits and pieces of information and trying to build some crazy story about it all. People are basically acting as if they have all the facts and going from there. Short memories. Everyone was saying case was cold until the day before the arrest and were wrong then and probably wrong about a lot now.

DM just gave a vague description. It so happened that her description aligned with the guy they'd already suspected.

She also provided a walking path on which they found a footprint.

Her auditory observations help establish a timeline and possibly clarify some events.

Nowhere has she pointed a finger and said, "He did it."

Not me! On page 7 of this thread I stated "i think they will find him. may take a while, but police will put tons of effort into this case for a long time."

Three pretty white college girls aren't going to get murdered without there being a tremendous amount of police/fbi resources for as long as it takes to catch the criminal.
