Oh that gal. She was on Rekieta and Legal Bytes a few times during one of the trials. She had good points on occasion but overall not really impressive to me.

Rekieta had a show last night going through her beef with Branca over the cop shooting the kid eating a hamburger at McDonalds.

Watched the video of that. Legal analysis leaves some doors open to interpretation of the officer's actions. He was fired for not following police procedure in the approach, that's an employment law question, not a criminal unjustified use of force question, yet.

On Natalie's stream tonight she commented on some of the answers the detective was giving to his questions and said she would be screaming for a mistrial as a defense attorney. Some of the answers were conclusory, speculative, and prejudicial, but he doesn't know that. This is coming from a career defense attorney who really does not like Brooks at all.

Hopefully that won't be grounds for appeal.

I essentially asked this question a few pages back. Can DB appeal based in inadequate representation? The concensus was no. That was a stretch of very poor representation that's all on him.

Covid was my concern when the jury was coughing. Again, nothing more than a head cold and maybe a fever for a day or two. Most people can work/sit through it but because it is "Covid OMG we are all going to die."

If he takes the stand and says that as testimony, it is game over. Dismiss the jury. Have a colloquy if he is changing his plea to guilty or nolo.

Attorney X is probably thinking he is smarter than everyone while wearing his mask.

Coughy McCoughface is not coughing, likely the juror. When I had omicron last month the only debilitating thing was the nagging cough which was more annoying than anything.

I didn't realize the jury was so predominantly male. I think I heard 2-3 female voices.

They did not excuse the juror today. Juror willing to continue serving.

So we still have 15.
