Absolutely there are. We just spent three weeks listening to a trial on the appropriate selection and escalation of the use of force. Now are you honestly saying shooting a woman crawling through a window is an appropriate use of lethal force?
This is where it does indeed get not so clear-cut. There is every reason to believe she entered without having to break anything, and video shows simply processed with others in a classic more Democrat-style loud intimidating mob to the House door. She is not one of the planted agitators battering the doorway of the Speaker's Lobby. But when someone knocks out a pane, she starts to simply go through and advance. And is shot dead. Very deliberately, and very aimed.
Since a trial has to look at the individual evidence and not the aggregate or some made up "overall" narrative, it could get tricky absolutely showing that shooting was needful in a way so many Left oriented ones directly confronting Congress members to their face was not dealt with by shooting. The sense of risk was easily as great.
Only hindsight provides the insight that House members were evacuating at the other end of the hall and that was a particularly suicidal thing to do at that moment. It is not true though, that Pence or Pelosi were near. Pence wasn't at that end of the building, and Pelosi had already fled. But House members were.
It would need a jury fully aware of what a "good shot" is --- and so many on this board say it doesn't qualify. Very hard to tell. It is very deliberate, that is for sure. But it is hard to see it going otherwise in any other government except maybe one of the Scandinavian ones. Perhaps that is mistaken.
