That is a crap argument because this kid did not exist until they chose to concieve it by buying the egg etc. It's not like he was up for adoption.

So when this relationship ends, as it inevitably will, how will custody work? Lets say Dad1 decides to leave Dad2 and Dad2. Does Dad1 get the child half the time or a third of the time?

The OP article mentions birth certificates, not marriage certificates.

It will probably be resolved the same way a divorce court decides custody for inevitable "traditional" marriage break ups.
