We're not challenging anything software related, of course there could be hidden code tampering. But if it did what you're saying there would be a paper record, thousands of Trump voters would get printed ballots that say Biden/Harris. Or maybe you're suggesting the BMDs record an opposite electronic vote of the printed version? That wouldn't work.

The process ensures every voter holds a physical piece of paper with their selections clearly marked in English before they cast it in the tabulator, which can be verified with a hand count. Nothing gets counted until that last step.

the printed form has who the voter selected written in english on it. they did a manual hand recount of these printed forms. the vote tally was essentially identical across the entire state. where is the room for tampering?

This is a much more aggressive lawsuit than I was anticipating. I'm actually kind of disappointed that is wasn't more measured.

Several observations here:

1) Nothing new in this lawsuit, as far as facts (alleged) are concerned.
2) This will likely build political capital for Paxton in Texas.
3) The fact that filing a lawsuit like this will build political capital for someone will not go unnoticed to other politicians.
4) The remedies Texas is asking for include excluding the electors as legitimate. I would anticipate that SCOTUS might point out that this is the realm of the US Congress. The Senate and House have to agree to exclude electors. Highly unlikely. But, I would not put the GOP from making the HOR vote on this to get people on record, and raise a fuss.
5) I doubt that SCOTUS takes this up. However, I was interested in Texas's argument that SCOTUS doesn't have a choice, they have no discretion to take this up. This is an issue I am completely ignorant of. I would be surprised if Texas is right.
6) I wish that there was room for a re-vote in these states under current state laws. That would seem to be the most equitable thing to do, and still follow the law. I doubt that this is feasible.
7) If SCOTUS does take this up, I hope they address the illegality of the states changing rules to violate state law, regardless of whether or not they provide any remedy.
8) I also hope they address the issue of whether legislatures can assign their electors however they want, regardless of current election laws.

Interesting late night shot across the bow by Paxton. So much for Safe Harbor day. It's plausible that one of the purposes of the timing of this lawsuit is related to the media hoopla around that.

The bill of complaint actually is embarrassing because it is way more PR stunt than anything substantive. It's essentially an amalgamation of already raised (and rejected) claims, which is one reason it is extremely unlikely the court will grant the motion for leave.

Even granting the legitimacy of certain arguments, such as the electors clause arguments, the actual pleading is written more like a press release than a legitimate legal filing, as it includes scores of outlandish, nonsensical, and frankly irrelevant assertions and "statistical" arguments.

It is somewhat hard to imagine a case in which a state brings legitimate elections claims against another state, although probably not impossible. However, this is not one of those examples.

And as someone else mentioned, it is probably very telling that Kyle Hawkins is not on the pleading.

See, this is the kicker for me. Even in this thread, the word "autocrat" has been thrown around. Trump is called dictator, etc, while doing a FAR better job of staying in his lane than Hussein ever did. Biden already talking about confiscating 401ks and infringing the 2nd amendment.

There is video of impropriety in GA.
PA violated their own constitution.

This just can't be waved away as nothing.

What's embarrassing is that ANY American would not want a full and reasonable explanation. There is no way Fulton County can tell everyone to leave, haul boxes of ballots out from under a covered table, then dump about 100,000 votes for Biden into the count at 1AM, and that's OK. It's not OK for PA to violate their constitution to enable what everyone knows is the easiest way to cheat. It's not OK to ignore the sworn affidavits of the people who witness impropriety.
