Appalling that it works that way, isn't it? I still think that collateral estoppel could be employed across cases. It is usually the same defendants. If they plead a defense of no harm before the election, they should be prohibited from pleading laches after the election, even if it is a different party suing them on the same issue. Not do I think equitable doctrines have much importance in a case brought under the laws, not to the degree they should be this dispositive, at least.
