"... is not a legal determination of culpability or intent." But it sure is a political one, just like charging the officers with first-degree murder before an investigation.

By the way isn't it interesting that he was murdered in two different ways - mechanical asphyxiation and cardiopulmonary arrest? Guess the cops should be charged twice.

Already saw it. Doesn't fix the problems with the Baden autopsy report.

The ME also has an issue, admitting on May 31 after receipt of the tox report that had Floyd been in any other situation, he would have ruled it an accidental overdose. He's going to have a very hard time explaining that to a jury.

They aren't getting off of the charges. They may on appeal, but there isn't a court in the country with the balls to address this for what it is. The court of public opinion has spoken.

its kind of like a car crash where someone is killed by a drunk driver. Do we blame the drunk driver (george floyd dying by OD, with the help of him resisting arrest), or do we blame the car (police, for doing what was forced on them to do)

Have you watched the entire 40 minutes of body cam footage? Because Floyd was complaining he couldn't breathe nearly from the get-go when he was standing up and only hand cuffed. He was acting erratic and resisting arrest. Knocked his head against the partition in the squad car cutting his lip.

There were no injuries to his neck, trachea and he was easily intubated when the EMS finally arrived after being called twice. Why is it the officer's fault that the EMS got lost? So did the firefighters responding to the call. Dispatch sent them to the wrong location.

Floyd had overdosed before and taken to the hospital where they revived him.

listen, i'm fine with saying that it is a murky situation and at trial all the evidence can be laid out plainly.

but the original post i replied to stated plainly that he died of an overdose and made no mention of the police officers' role in his death.

can we agree that that is a bad take?

No, I can't agree that's a bad take. I analyze the evidence as to whether it supports the actual charges and if that evidence reaches beyond a reasonable doubt standard. The evidence does not support the required elements of the charges as they stand now.

Listen, I was just as angry and upset at the 8 minute video as the next person and thought Chauvin had used excessive force. Within a few days of his death, the Hennepin County DA was giving a presser alongside the US Attorney. At that time the DA stated the investigation was not complete but he wasn't sure there would be any charges. He had seen the prelim autopsy and the body cam footage before saying that.

At the time I was shocked that he said it while Minneapolis was still burning. Even if he had serious doubts about the case, don't express them under those circumstances. It was shortly thereafter that AG Ellison swooped in and took the cases away from the DA.

Ellison was pandering when he vastly overcharged Chauvin and then scrambled to find some tenuous at best charges against the other officers.

There is vastly more exculpatory evidence than there is incriminating evidence other than the viral video. Problem is the medical evidence doesn't support what we all thought we were seeing on the video.

Defense counsel can blow a hole the size of an 18 wheeler in the prosecution's case. The prosecution witnesses have already had credibility problems. Baden with a malpractice level of an autopsy before the tox report or tissue analysis was complete and the ME with the admission that he would rule the manner of death as accidental overdose. That was on a conference call and then written up in a memo to the file before Ellison filed the charges.
