No grand jury material yet. Nor do I think this faux resolution ploy by Pelosi and Schiff will move the needle much in terms of them getting said material, under McKeever.

I think the ruling will be upheld and end up in front of the Supreme Court.

I don't. It won't get past the DC Court of Appeals. The McKeever case was just this year. Doubt they overturn their own precedent in less than a year. Had Pelosi held the vote and launched formal impeachment proceedings, maybe the Dems could have prevailed here.

Despite the GOP howling about the ad hoc procedures being employed by the House, the real play here was in the court. Judge Beryl Howell may have bought their crap but the entire DC Circuit Court likely will not. Unless they want to appear to be fools. (Which is not outside the realm of possibility.)

"Congress' ability to impeach can't be impeded by a court rule." It's not a "court rule" it is a federal statute called the Federal Rules of Criminal Procedure.

I think the McKeever case plays into disclosure in this case. That case ruled that the grand jury information releases needed to be limited to the enumerated exceptions in rule 6e. One of those exceptions is:
(E) The court may authorize disclosureat a time, in a manner, and subject to any other conditions that it directsof a grand-jury matter:

(i) preliminarily to or in connection with a judicial proceeding;

The McKeever decision stated that an impeachment proceeding is a judicial proceeding to rationalize the release of grand jury materials during Watergate hearings.

I've already been through it with this chuckle-head. Based on his interpretation, if congress is currently in a judicial proceedings, it's ALWAYS in judicial proceedings. Which is a terrible design and separation of powers.

Your assertion that because the House doesn't require a vote to initiate impeachment the House is always engaged in impeachment, is idiotic.

The constitution doesn't differentiate between impeachment of Presidents and Federal Judges in the House, and we've impeached a bunch of federal judges without a house vote initiating the process.

Asking a judge to hold up grand jury material waiting for a house vote to initiate impeachment would be asking them to uphold a law that doesn't exist.

Gee, there is no inherent power of a federal court to release grand jury material unless it is within the Federal Rules of Criminal Procedure rule 6(e).

Constitutionally, Article I committees are not vested with Article II nor III powers. They require both to enforce their edicts.

Do you disagree with that? Does the House have their own law enforcement and court set up that I am unaware of?
