Jussie Smollett is steadfast on clearing his name of allegations he staged an elaborate hate crime against himself and wants the lawsuit that the city of Chicago filed against him moved from state court to federal court.

The motion filed Wednesday and released to the media by Smollett's representatives comes after the city sued the actor in April for the cost of investigating his allegations that he was a victim of a racist and anti-gay attack in downtown Chicago.

Prosecutors dismissed charges against Smollett related to making a false report. However, the Police Department and city officials maintain Smollett orchestrated the January incident and they're trying to recoup $130,000 the city spent on police overtime.

In June, the Police Department released a trove of evidence gathered during the course of their investigation into Smollett's claims and surveillance video obtained by Fox News on Tuesday appears to the embattled actor and the two Osundairo brothers whom police insisted the actor paid to pretend to beat him walking around the vicinity of the alleged attack perhaps mere minutes before it happened, according to police notes.

Smollett's attorneys argue federal court is the proper venue for the case because the actor, who lived in Chicago while filming the TV show, "Empire," is actually a California resident.

In a motion for reconsideration filed on Friday, Smollett's attorney Tina Glandian pushed back on the order, challenging Toomin's apparent conclusion that Smollett is guilty. She argued that the two men -- Abimbola and Olabinjo Osundairo -- attacked Smollett, and then blamed him once they were caught.

"Other than the Osundairo brothers' self-serving statements which resulted in their release from custody with no criminal charges filed against them, not a single piece of evidence independently corroborates their claim that the attack was a hoax," Glandian argued.

She floated the idea that the brothers were motivated by homophobia, citing text messages in which Olabinjo referred disparagingly to another man as a "fruit."

Glandian also argued that the judge erred by appointing a special prosecutor, saying that Foxx was within her rights to turn over the case to her top assistant. Even if the recusal were mishandled, she argued, the state should not get a "do-over" once a court has agreed to dismiss the charges......

A Chicago judge appointed a special prosecutor on Friday morning to lead the investigation into the handling of the Jussie Smollett case


Cook County Judge Michael Toomin appointed former U.S. Attorney Dan Webb to the position to investigate the way the case was handled specifically, why the 16 criminal charges against Smollett were dropped and to potentially reinstate the charges or even add additional charges against Smollett.

"Webb gained prominence for his lead role during the Operation Greylord investigations into judicial corruption in Cook County," Fox 32 reported. "He served as special counsel in the Iran-Contra affair and was previously appointed by Judge Toomin in the death of David Koschman."

Webb told reporters on Friday: "I don't know where this case is going. The facts will take me where they take me."

Toomin ruled that a special prosecutor was needed in the case because "Cook County State's Attorney Kim Foxx had no authority to hand [the case] off to her top deputy after announcing she recused herself," CBS News Chicago reported.
