For my part I'd say Sullivan being a white hat all of this time is a load of hooey. He never enforced his own Brady Orders despite repeated motions by Sidney to do so. Other parties filed for leave to submit amici briefs on Flynn's behalf which he steadfastly refused to grant. There are a dozen motions filed by Sidney that he has yet to rule on. He allowed Van Grack to repeatedly lie to his court with impunity about the existence of Brady and Giglio material and the Giglio material relates to the blatant conflict of interest Flynn's previous attorneys had regarding Flynn's guilty plea.

All signs of his bad faith. It is merely schadenfreude that Sullivan's animus and intransigence has allowed for this information to become public through court filings with the DOJ supplying Sidney with material that Sullivan continually refused to order the Mueller prosecutors to produce in contravention of his own Brady order that includes criminal contempt, meaning Van Grack's butt should have been in a jail nearly three years ago.

That's what it is--schadenfreude.

I think we do enjoy some schadenfreude certainly at the validation of our opinions/analysis in all of this as the DoJ lays it out now, but again the motivations are interesting to consider. Clearly, Barr/DoJ want this dismissed and I think it is not just Barr, but it is very embarrassing to a lot of folks still in various positions in the DoJ, which is one of the reasons the solicitor general is participating (at the trial court!!) on the 29th.

Institutionally speaking, this has absolutely cost the DoJ a lot of goodwill/faith from many in the public, and though I hate to attribute to a large body of people at an institution a human emotion, I think in this case it's not a stretch to say it collectively really wants the clown show ended asap. Many internally also know Durham will wind up shedding more light on the Comey/McCabe/Mueller/Holder era of partisan witch hunts (regardless of Nov. 3), which do relate of course to Flynn. Institutions always work to protect themselves first, which is why bureaucratic folks like Wray, Michael Young, Sharp, Weissman etc. get promoted/hired in the first place.

You're right, going back further Sullivan has been an absolute jerk/biased partisan toward Flynn the whole time.

Sullivan isn't a white hat. Everything coming out now is part of the Barr influenced comment about there being things the DOJ knows that Sullivan doesn't that Is further exculpatory for Flynn. This is William Barr saying to Judge Sullivan "I fugging told you to drop this. I told you why, and you still didn't listen. Now all your friends are going to look at you as the reason the corrupt FBI and their friends in various US Attorneys offices are done."

If the judge were a white hat, he could have accomplished what has now transpired in a less convoluted manner. The new argument implying his actions were justified is no more than an attempt to cover his bare a$$ with cheap paint. Still visible and still stinks!

I agree that Jensen's investigation is more focused on Flynn and the criminality of Team Mueller as it relates to Flynn. So a second (or third or fourth?) 302 done by Jensen for purposes of augmenting the record as to why Barr filed the MTD makes sense.

But I agree with Bonfire 1996, Sullivan pissed off Barr and he's opening up a can whup ass on him as a result. If Sullivan still refuses to dismiss the case, the Supreme Court will dog pile on top of the that.

Well, they have been a long time coming and few and far between during the corona and the Floyd crappola and riots. Rough several months.

But seeing the DOJ under Barr going to extreme lengths to right this injustice to Flynn does warm my heart today. What would also warm my heart further would be some perp walks, too.

Not to sound conspiratorial on this thread, but COVID-19 did more than just muck up our economy, and our rights of freedom and liberty.

It also vapor-locked any GJ processes set in place by Durham.

So, even though we waited with baited breath over the last 6 months, this very loud "BOOM" may have been what was planned for earlier...May or June, let's say. And the interim frustrations and anxieties are now being released.

Perhaps it will be a more relaxing time ahead...

This 302 and Techno Fog's summary have me feeling the best I have in a long time about all this, and I've been reasonably optimistic for a long time.

I have friends still stuck on the "but why would Flynn plead guilty if he wasn't guilty," and even bringing up the Innocence Project wasn't enough to convince them.

But this... this hits all the right notes. I don't think there can be any doubt once you read everything collectively. This agent's 302, plus the new and previous FBI texts, plus the Clinesmith charge...

Sullivan is, like many others in the legal profession, an egotist, but with some crap that he created splattered on his robes ("treason", the amicus stuff, etc.) The appellate court gave him an opening to regain his stature, but he insisted on stubbornly maintaining his position, oblivious to cautionary DoJ words about the other exculpatory stuff of which he was not aware...

B & D finally worked past the logjam of documents and GJ presentations, and Durham cleared GJ indictments. It took Flynn off the critical path, and now, Sullivan is nothing more than an obstinate little pawn. It should be a barn-burner of a hearing on the 29th (?).

That said, it is still a tough slog against the current...in spite of all of this information available on Twitter, FB, Blogs, and these threads, fully half of the population of the US are unaware of what has happened, other than us conservative nutcases who continue to promote conspiracies, old inferences and opinions to things "long dead". Why were we wasting our time, they say?

The key is how these waves will break onto the MSM shoreline...a tidal surge? a Tsunami?
