For Sullivan to rule, which ruling will then be ripe for mandamus, and the appeals court will not have any wiggle room (hopefully).

I don't know, but if all the phones were personal phones he may not have had the authority to obtain the phones. In this article it doesn't appear to clarify if these were government issued or personal.

I would hope AJ Barr and Durham would have the authority to get their personal phones.

I sure hope you are wrong. What will be the effect on those jurisdictions that will not permit Alford pleas? Puts a pleading defendant in a no-win. Chooses to plead guilty for a sweetheart deal, lies during allocution/court colloquy, and is now on the hook for perjury if actually innocent?

I'm guessing that Sullivan holds until after the election, forcing another mandamus petition. The best outcome we can hope for is following Circuit precedent, dismisses with a scathing Order claiming corruption by Barr and the DOJ is the likely reason for the dismissal - and this drops the Friday before election day.

The reason I think Sullivan is intending to sentence him for perjury is because it was his idea. He said it in the minute order naming Gleeson and directed him to brief on that specific issue.

And you are correct about Alford pleas. But Sullivan is too untethered to the actual law at this point to care.

It's all about trying to force Trump to pardon him before the election because they know a pardon is coming right after regardless of who wins.

I just don't see any person voting or not voting based on Flynn being pardoned.

According to the article that you linked, these phones were issued to them. These were not personal phones

By the same logic, not bringing charges against anyone with even reasonable criminal evidence is a gross abuse. Prosecutorial discretion criminalized? Yeah, no.

And ALL of those files and messages and emails were federal records. Deleting or mishandling each one could be a felony.

They don't even have a charge to produce ANY report, just investigate and prosecute crimes. The IGs produce reports of problems and fixes...if they do their jobs.
