DOJ's option to file their opinion of Flynn's petition for a writ of mandamus, if they so choose. They have indicated they will.

Sullivan has been ordered to defend himself by today.

I'm not sure the DC Circuit will accept a filing that doesn't have Sullivan's signature on it. He was ordered to respond personally. The DC Circuit didn't appoint an amicus for him, either.

Could Sullivan make this all a moot point and enter an order granting the motion to dismiss? I still can't wrap my head around any justification or rationale for not entering an order granting the dismissal weeks ago.

I want Flynn to be free of this **** show and for arrests.

I suppose he could but doubt he will until he is either removed from the case or directed to enter the order for dismissal. He's too dug in to correct course now.

Judicial Watch president Tom Fitton will be allowed to ask Hillary Clinton at the deposition. The judge didn't allow every question Judicial Watch has for Hillary, but a in a twist, even the court is curious about some behavior, statements, and non-statements, Hillary has made in the past.

What happens if the Judge ignores the circuit court order and pulls a don't show/doesn't respond? Won't happend, but please tell me he gets kicked off the bench and goes to jail.

Wilkinson is a great lawyer but her whole 46 page submission is shear desperation to let Sullivan draw this out. The case law she cites to let this go through the POTUS nominating conventions (Sullivan/Obama's goal) is really weak. That O'Shea was an interim USA doesn't make the fact that he concurred with Barr/DoJ on it after extensive review of the evidence (now largely declassified/public) less credible, for instance.

So is Sullivan just trying to stretch this out or is he intent on destroying Flynn in order to keep him out of the administration?

Had to go to the store. Just got back. I read only the the titles of the arguments and just rolled my eyes. Didn't even bother to read the body of the brief. Pure unadulterated horses***.

A federal judge telling his superior appellate court they aren't smart enough to figure out this case without his superior intellect and wisdom is pretty brazen but it isn't a legal reason to deny the petition for a writ of mandamus.

Sullivan went with: Mandamus isn't proper; and, he should be able to appoint someone to argue the other side.

I've seen others make the mandamus argument and it's reasonable. Appointing an amicus in this situation can't be done, no matter how much he cries.

Are we still thinking DOJ will join the defenses mandamus? They did say they were going to... Cutting it a little close to the bell.
